  • If anyone had got any advice/help/or know's on what would be the best course of action for me and my wife then it would be great if you could comment.

    I will start from the begginning, that way I will have covered every aspect of my claim towards Lloyds TSB.

    This all started in September of 2005. On which I wrote to the bank asking for a complete list of charges on behalf of my wife. This was adhered to by the bank and complied with on the 14 day rule. My next task was sifting through all the relevant charges and then writing another letter to the bank asking them if they would refund before any other action was taken, again, I waited and the bank was within the time scale of replying stating "I'm sorry your not happy, blah blah blah, but were not refunding", I then sent the bank a 2nd letter giving them the option of refunding all charges otherwise court action will be starting. This is the point on whihc the bank stopped being helpfull and since then have not been in contact since. I waited a total of 16 days (just to give them the benefit of the doubt and also the dodgy post that seems to be a constant problem in suffolk), I then lodged my court claim on line and paid the fee. My next step was filling in the court allocation questionaire, I filled all of what I had to and sent this back, Within a few weeks the bank had filed a defence stating that I was in the wrong and not them. On the 9th November 2006, I was sent a letter from my local court with a list of 6 things to do. One of them was to prepare a court bundle and send it to both the court and the solicitor acting on behalf of the bank and return it by the 8th January 2007. This i did on time.(Everything I have sent to the bank/solicitor and to the court has been recorded delivery) I phoned the court yesterday as I had not heard anything and the told me that the bundle had just gone through to the judge concerned. I wrote a message on this website last night and was told to phone the court to see when the court date was. In the letter i recived from the court I was never given a court date just a date to send the court bundle on. I knwo that everything I have done so far has been all help from this website and I can't thank the people concerened enough, But I must admit that I am worried that I have done something wrong as it seems that most people have at least heard from the bank as a way of an offer for their incompetence. We have received nothing. I'm sorry for such a long messgae, but I feel it's best to state everything up to date that way if anyone can understand what I have explained then they might be able to offer me some sort of assistance.

  • I'm seperated from my wife who is now living abroad. The joint account was changed to have only my name on last february. The account number is the same but will the refund if I get one, be in both our names, and if so, will I be able to pay it in to a new account I will be opening.

    Today I will be sending off my letter for my charges.Two weeks ago I asked First Direct for a list of charges applied to my account since it opened and thet sent me a copy of all my statements.I've totalled up all my charges (£995) and have another account open just in case.Don't really know what figure I should accept off them as any amount is more than i've got today but will keep you posted what happens.

    Claim in your name only. The payment will be made straight into the account (in which case, only you have access to the money), or you will receive a cheque in your name.

    I still wouldn't worry if I was you. You have done everything spot on. Next, you will get your court date.

    Some banks are leaving it as late as offering a settlement on the court steps before you go into see a judge. A few people have received a letter with their offer a few days before the hearing date. There has also been cases where the bank have made no offer, and have not turned up to court. If this is the case, you will win straight away by default (you wont have to go through your hearing). If the bank doesn't pay up then, you can send the bailiffs in!

  • Can someone advise me please, I have an OD of £3k with barclays and a barclay cc card £3k.

    if i write to thgem will i be safe caliming charges back or will they ask me to settle my accounts?

    Total claimed £1309 ex int
    total recived £1150

    sent my first letter of on the 3rd of jan signed for ( bank never got it !)
    sent my second letter signed for 16th bank never got it!!
    Faxed both copys of letter off to Leeds on the 16th of JAN
    had offer today for the above in a letter dated 23rd of Jan

    So really the turn around time from them reciving the letter to paying up was 7days!!!

    Just one question I have two accounts that have been heavily charged over the years at HSBC - but at different branches. I am not sure where I should send my first letter to? I'm not sure if my local branch can deal with both accounts, or if it gets sent to a head office?

    Your first letter goes to the data protection department. Look at the link in the post above yours, it gives you the address you need. Put both account numbers in the same letter along with one £10 payment.
