Many thanks Martin for your advice page.
Using the template letters, I successfully claimed and recieved £870 from First Direct.
Interestingly, their final letter denied that they had done anything illegal and that they were confident that a court would uphold their case.
However, they continued to say that the legal costs incurred by them in fighting this case would not justify the end result so, for purely commercial reasons, they would pay my claim in full.
This refund has now been transferred into my bank account.
Again, many thanks for the advice.

With regards to credit card statements I presume I write to the HSBC's head office for credit cards?
It's the only address I have for them or would this be something the branch I opened it with would deal with?

Amount Reclaimed: £60

The story:
Barclays took 3 paid referals in a matter of three weeks.
I confronted them at the bank and they gave me one back.
Saw you on BBC Breakfast and printed off your form and sent it in......
took about 2 weeks if that to get the money refunded....heres an interesting part of their reply................
"...the fee has been charged in accordance with the terms and conditions of your account. Please note that it is not usual bank policy to reimburse charges......However on this occasion as a gesture of goodwill I have credited your account with £60.00..."
When has a banks gesture of goodwill been anymore than a cheap plastic pen with their logo on it?
Finally here's a barrel we can get them over...

i know this may sound like a bit of a daft question,
but im just about to send a letter requesting my statements. Just wanted to find out which adress id send it to, my local branch or the head office adress?

17th November 2006 - Sent 1st letter
13th December 2006 - Sent 2nd letter claiming for £1874 + interest
29th December 2006 - Sent 3rd letter
2nd January 2007 - Received offer for £1874 (no interest)
3rd January 2007 - Sent signed acceptance form
19th January 2007 - Phoned to chase up money
20th January 2007 - Money paid into my account :T0 -
Firstly thank you to you all this is an excellent site! Which may just prove to be a godsend for me!
I have an old Halifax credit card, which defaulted, and transferred to a debt agency (currently making payments) however I had several charges on this account, which I would like to reclaim. (It was mainly charges that caused me to go badly into debt!)
Is this still possible now the account has been transferred?
Is there much difference between claiming charges from credit cards or banks?

THE STORY
just received a phone call from them they spoke to the wife they offered us £2500.00 wife said youl have to speak to hubby got on phone i said want the full amount £3157.00 he said il speak to the teamleader, about 10 secs later said because weve been a loyal custermer for 19yrs they will give us a full refund of £3157.00. its fantastic. I've been on this since last November but this is my first post. Upto now I have managed to use all the links and advise everyone as given and would like to say a BIG THANK YOU to you all. But unfortunately I don't know what to do about a letter I received back for the Monument VISA card; they have offered me a partial payment but before doing this have taken off the new reduced charges of £12.00 recommended by the Office of Fair Trading. Can they do this? Can I not claim back theses £12.00 charges? Is this amount a legal amount for the credit cards to charge? Also when it gets to this stage and I don't want to accept the goodwill gesture of partial payment they have offered (Because it reduces the amount claimed down to next to nothing) do I carry on with taking them to court now. Sorry for being a dim wit on this subject, but it's all new to me. Thanks in advance for all your help with this matter. And thanks again for this great site.

I would carry on and take it to court, the £12 is only recommended by OFT.
The Official view
In April ‘06, the Office of Fair Trading opined that credit card charges were too high and should be reduced to £12, which most plastic providers have since done. It’s undoubtedly a positive step, though many may still think £12 is too high; yet it adds weight to the case for reclaiming charges as it makes all prior charges look too expensive.
At the same time it also mooted that similar logic applied to bank charges too, though this had less influence and hasn’t been adopted by the banks. However in Sept. ‘06, it announced that banks would have to open their books and justify penalty charges when they’re made.
