does anyone know what happens next?

On the 8th January I sent my court bundle to my local court and also a copy to the solicitors acting on behalf of Lloyds TSB, does anyone know what happens next or when I should hear anything. I have done everything that has been suggested.

Please help, big panic and worry is starting to set in.

If you've had to send in your court bundle, you should have a court date set. Phone your local county court, quote your case number, and ask them what is happening with your claim. I've always found the court staff very helpful.

Anyway, I wrote letter 1 to our bank (Woolwich) on 16/12/06 (the one asking for the list of charges), and Barclays Data Protection Dept. replied eventually w/c 8/1/07 saying that they will have a reponse to use by 6/2/07. Also, they said that they would do this for us "on a complimentary basis", which I am suspicious of, as no banks do anything for nothing!!! ;)
Their 40-day reponse time expires on 25/1/06, so my question is, should I bother to send letter 2 to them, or let them have the extra 12 days and give them untyil 6/2/07 tp reply?

The 40 days is set out in law (Data Protection Act). This starts from the time they received your request. If you have a telephone number on the letter that was sent, it may be worth a call to remind them the 40 days is a statutory time limit, and you would be entitled to complain to the Information Commisioner if they don't send your statements within this time.

In reality. A complaint to the IC would take a long time, and Barclays say they will respond by 6th Feb. Try a call, and see what they say.

Barclays do not charge for this info, so this part is normal for them.

  • I'm about to send my first letter to Nat West and was wondering where I should send it to - to their head office, address and contact name I got the statements from (In Edinburgh), or hand it into a branch.

Also do I send it by registered, recorded post (and whats the difference)
  • Thanks for the advice. I just got off the phone from Littlewoods and GE Capital storecard. Their charges range from 10 to 20 pounds (littlewoods managed to charge me 4 charges of 10 in a month!

Im still a little confused as to whether I can claim these amount back because they seem excessive for sending a letter, but I have the 12 pound figure stuck in may head?????

    Anyone?

Yes you can reclaim these charges.

The £12 figure is only to do with credit cards. Even though it has been set up as an upper limit for charges by the OFT, they still say this does not make a £12 charge lawful. Only a court can decide. None of the companies have let this get to court yet because they don't want to lose in court (they are still settling out of court).

    Go ahead with your claim!

    Claimed £750.00
    To receive £750.00

Wrote to my branch (sent special recorded as didn't want them to say they hadn't received my letter) on 27 Dec, received an offer over the weekend to pay everything I asked for direct to my account - have accepted this of course!

Thanks so much Martin and all the posters on this site, if it wasn't for all your advice and encouragement I wouldn't have done it! Was quite nervous at taking on the RBS as it would appear they can be difficult but if I can do it...

Will go after Egg and MBNA next. Feeling confident I can get myself out of debt - at long last! :-)
