    Hi All

    I've just joined this site and would like to say it's interesting reading I am additicted!!!!
    My story is I have received statements back from Barclays and worked out total charges. Which is a total of £1255. Do I send second letter asking for this back without without interest. I have read a few posts that have given advice to firstly ask for money back without interest.

  • Just to clarify I can claim back 'account charges' as my account is supposedly free and the interest on my overdraft is the banks?

    It was the above comment that confused me about your account being "free".

    I have a "free" overdraft of £100 but if I go above that amount I have to pay interest, is this what you mean by "supposedly free"?

    You can't claim the interest on this but I would suggest you ring your bank and ask them to clarify exactly what they mean by Total Charges as each bank uses different terms.

    Double checked with a friend who has done this already and the "Total charges" are the penalty charges just reworded to soften the blow so to speak.
  • Hi my bank has just landed a letter for £352 on my doorstep. I havent paid the charges and as a student am in no position to pay the charges before claiming, do I have a case for claiming that the fees are dropped rather than refunded?


    Your help, as always, is extremely appreciated.

  • My daughter wrote to Lloyd's on the 6th January requesting her bank statements and included a £10.00 cheque. She has not heard from them and has just realised that she sent the letter and cheque to the wrong address, she sent it to her local bank. Her partner has also done the same thing. Should they just do the whole thing again and send to correct address? Do you thing she should contact their bank explaining what has happened, or would the letter have been passed on? I'm not sure how long from the first request she should expect to wait before receiving the statements?

    On the 8th January I sent my court bundle to my local court and also a copy to the solicitors acting on behalf of Lloyds TSB, does anyone know what happens next or when I should hear anything. I have done everything that has been suggested.

    Please help, big panic and worry is starting to set in.

    The bank has 40 days to give the information requested so there is still plenty of time for her to receive it but I would suggest she phone her branch and ask if the letter has been passed to the appropriate department.

    Its worth listening to Martin's audio file in this link as sometimes you can read too much and this makes it clearer :)

    Charge interest on top
    If you won via the courts, you would be entitled to add 8% interest (not compounded) on top from the date you were ‘first deprived’ of the money (i.e. the date of each charge). Therefore you may want to ask for the interest as part of the initial claim. It's important to understand that you are not legally entitled to interest unless you win in court, yet all prior letters are a tool of negotiation; think of it a bit like haggling.

    You may get lucky and get the interest on top, but even if not, the legal feedback I've had is that it’s one route to pushing the bank to settle quickly so it can offer to pay you without the interest. Of course there is a risk that asking for too much makes them less likely to settle too - sadly this is an art not a science. This isn't an easy concept so I've recorded a quick audio file which may help explain it.
    For those who do want to ask for interest, I’ve had the calculator below specially built to work it out for you and included it as an option in the template letters later. However, if you'd prefer to play safe simply ask for the charges without interest in the early stages.

    Hello All! :hello:
    I'm new to this site, so bear with me! It was Martin's article on the appalling bank charges issue which drew me in and has me hooked!
    My hubbie and I have been accruing charges for yonks now, mainly due to our poor management, I'm ashamed to say. I would estimate we're looking at between £2000-£3000, as our bank charges £35 a time for failed d/debits etc ... shameful ...
    Anyway, I wrote letter 1 to our bank (Woolwich) on 16/12/06 (the one asking for the list of charges), and Barclays Data Protection Dept. replied eventually w/c 8/1/07 saying that they will have a reponse to use by 6/2/07. Also, they said that they would do this for us "on a complimentary basis", which I am suspicious of, as no banks do anything for nothing!!! ;)
    Their 40-day reponse time expires on 25/1/06, so my question is, should I bother to send letter 2 to them, or let them have the extra 12 days and give them untyil 6/2/07 tp reply? I'm tempted to give them the extra time on this occasion, but am really worried about proceeding with the issue, so just want it sorted!!!
    Any advice would be gratefully received!
