Yes they can ask for the account to be paid up/closed.

Its now been a week since the court sent the default niotice but still not heard anything from abbey! Please could you tell me wot to do next please? Do we give them more time or do we contact the court again? Thank you.

Once you get judgement, the court will send Abbey a request to pay you in full. If they ignore this (they get a time limit). You can apply for a warrant of execution. You can then send the bailiffs into the bank to collect the debt.

Many thanks to Martin and the website
Found the website very helpful. Used the template letters. There where two charges on our statements so decideded to claim both. Had to send the letter saying if they did not respond in 7 days we would take them to court. On the last day got a letter offering us the full excess bank charges and half the overdraft charges. We have agread and the money has been credited to our account. I would never have thought to try getting the money back if it had not been for the website.

Where did you hear this, from your bank manager?:rotfl:

That's the first I've heard of it, and I had a look around now to confirm I hadn't missed anything. Not a whisper.

This is the sort of thing the banks would love you to beleive.

  • What is the best way to send the letter to the bank, by registered post? Also where do I send it to? I am claiming from Nat West and I received a letter from PO1000 Edinburgh when I got a letter saying the statement charge was only £5 and they wanted me to resubmit my claim. I was given the name Joyce E Tudor
