    Excellent site and advice. I have been persecuted by bank charges and following the advice on this site have submitted several claims to get back all my charges - with mixed results. Barclays wrote back with their standard letter "we are concerned and will investigate, replying before 23 Jan 07". Bank of Scotland offered a "goodwill gesture" of £60 refund (£995 claimed). Needless to say, they got an LBA. Capital One havent bothered to reply. MBNA wrote today offering £570 as a "goodwill gesture", (£965 claimed) stating that a cheque for this amount will be sent within 10 days in "Full and Final Settlement". This poses the question - do I cash the cheque, and send back their acknowledgement letter, amending the letter refusing to acknowledge their terms, send one on the lines of the LBA, but with a line thanking them for their interim payment, and persue them through the court for the balance plus interest? Or should I just accept it, cash the cheque and move on to the next one?

  • Woolie, if you can in any way hold out and refuse the offer do it - I really think they will increase their offer dramatically if you do - its a paltry offer percentage wise.

    When I was about 18 I had 5-6 store cards. Look back now it was stupid considering the interest rate they charge but at the time I didn't really think about things like that. :rolleyes:

    Anyway, the majority of these store cards (which are fully paid off now) were with G. E. Capital. If I am going to claim from them, would I need to write seperate letters for each store (eg Topshop, Debenhams, etc.) or could I send one letter asking for all my accounts on one list if they were all with the same company?

    One letter, and one £10 payment should be enough for GE Capital to send you all the information on all the accounts. Make sure you include details of each account that you are enquiring after (shop, account number, etc).

    i bank with natwest also i went in the bank and asked for my 6 years worth of statements, and i told them why they were fine with me and only charged me £5 and they came within 5 days ,they also told me that i could off done it over the telephone (orded my statements)

  • I am currently a student in brighon and i found out about the charges being made to my account and how this is very wrong. I have sent a letter to abbey stating an estimated amount of over £5,000 over the last three years. i sent the letter on 21/12/2006 and got a reply today 19/1/07 stating i'm on there complaint list and it will be delat with. I dont beleive this for a second. I am going to send another letter saying i'm still waiting for the refund if not done in 7days i will take them to court.
    I'm worried that i wont be able to afford the costs of the court as i'm a student and abbey takes all my money. Is there any help?

    I'm going to the court soon to get more information. Any advise from people in this situation would be great

    First of all. Get in touch with your local county court, and ask about court fees. If you are on a low income or benefits, you may be able to issue a court claim for nothing.

    Do not proceed with your claim on an estmated amount. You will very likely get all your charges back (about 99.9% certain). A lot of banks are only paying the charges after a court claim has been issued (and before it gets in front of a judge). If you issue a court claim, you will have to produce a list of the charges you are claiming for. If you have estimated your charges, you can't do this. If someone claimed you owed them money, and took you to court for it. Wouldn't you expect them to prove the amount they claimed you owed? Saying in court that you've guessed the amount (estimated it), wouldn't look very good, and could lead to the claim being struck out.

    Read Martins article, and go back to step 1. Write to the bank using the Data Protection Act, and get all your statements. Once you've got these, make a list of your actual charges, then make your claim based on fact, not supposition. You will increase your chances of success if you follow the steps in Martins article properly rather than acting on guesswork.

    Hi first time on a forum, newbie to everything including the damn computer, can anyone tell me of any website with info about claiming bank charges on an account that was at one time in joint names, do we have to claim together or can I do it as I was the main account holder Thanks

    Either of the individual names on the account can claim on a joint account.

    Write to the bank and say...................

    I cannot accept your offer of £686 as full and final settlement of my claim. I will accept this as part payment and without prejudice, but I will continue my claim for the balance.

    Then, if the bank pays you this amount, adjust your claim for the balance, and carry on.

    Continue with your claim for the whole amount. Do not bank the cheque if they send it as full and final settlement. Only bank it if they accept that you are accepting it as a part payment.

    Marvellous - I wrote to them on something like the 9th of January, got a letter on the 18th saying they were looking into it, and then got another letter this morning (20th) to say as a gesture of goodwill they were paying £240 into my account.

    I'm really pleased that it has happened and that they have acted so promtly on it, but am a bit ticked that they still state that as with the terms of the account any future charges will still be applied at the previous level. I guess a review of the charges might happen if enough people press them on it.

    Nonetheless, I'm glad a bank I had trusted for 10 years has acted so quickly. Oh, and the money was paid into my account overnight.
