Any Help with Particulars of Claim
I copied and pasted martin’s particulars of claim into moneyclaim.gov but it says that it is too long too many characters and too many lines any help with that.0 -
Please forgive me but I am new on this site and there seems to be a heck of a lot of information to take in and to be honest I have no idea where to start!
I apologise if my questions have been asked many times before, I am currently at the stage where I have sent my initial letter to the Halifax and I have not heard a thing from them except a letter saying that they have received my letter and they were passing it on to someone else and they would be in touch asap, but alas this has not happened. The 14 days notice is almost up and I am about to start legal proceedings and I am scared to death about that! I do not know what information to put into the Summons as I don't want to mess it up and have it thrown out of court for not having enough information and on the other hand I don't want to drone on about stuff the court may or may not be interested in. Is there anything that anybody can help me with on this or point me in the right direction within this site where I could find this information, I would appreciate any help anybody can give me.

I have loads and loads of lines of charges - 4 A4 pages - to put into the particulars of claim! Can I just put in the total that I sent them in the post?
Also, sorry to repeat - in the address of defendant I've put Bank of Scotland and their H/O in Edinburgh but for the address for service i've put Halifax Bank of Scotland in Halifax (so I can use their English address for the small claim).
Waiting on tenterhooks and feeling a bit excited...Lou0 -

you dont need to put all your charges in the particulars of claim take a look at this link but i think it needs shorting a bit

I am confused the part I have highlight is that the amount less the interest
1.The Claimant has an account 1234567 with the Defendant, opened May 2000 2. Since 01/02/03 the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of £XXXX; (b) Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court.0 -

What letter do I send to the financial obdudsman?0

I sent my 1st letter requesting £1972 be refunded to HSBC Canada Square 6/12/2006.
On 3/1/2007 I sent them another letter stating that I would commence court proceedings in 7 days if I had not received a full response.
On 7/1/2007 I received a letter from HSBC in Leeds dated 5/1/2007 stating that I will be contacted agin by 7/2/2007.
My question is this, do I now go to Moneyclaim and start proceedings or do I wait until 7/2/07 for reply. My gut feeling is that any reply received by 07/2/2007 will not be satisfactory anyway.
