Bank: Egg
Amount Reclaimed: £16.00
Amount they paid: £16.00
The story: Phoned up the normal customer services number, and no joy. Was told to phone 0800 783 4393 instead. Spoke to friendly customer service representative who told me that egg's position was that the charges were not illegal, and that they were in talks with the OFT regarding this, however since it was my first penalty charge they'd refund it in full - no hassle.
Thanks MSE! If I didn't have all the details I wouldn't have been confident enough to make the claim!!!
My tip: Keep it friendly if you ask for the refund over the phone. Remember, you're usually only chatting to a phone representative, not the people who make the real decisions. They're only doing their job. If you're nice to them, they'll be more likely to want to help you, and argue your case to their supervisor!!What shall I put here?0 -
hoggin wrote:Many thanks for that, but I think I may have answered my own question, when I looked at my statements for the last 2 years I found they had charged me either £25, £50, £75, £100 or £119 each month and not £10 per transaction over the arranged overdraft as I had though, I have worked out I have paid £1283 in the last 2 years. As soon as my new account is open off goes my letter. I don't see why I can't contact first direct through there web page and ask for the figures for the last 6 years as they don't seem to charge for this, there would be records of this in the event of a court case, which of course I am expecting to go all the way. Any one think this is a bad idea?0

Hi
I received my letter from A&L suggesting my £500 plus charges are lawful.
Next step suggestions please, should I submit another another letter stating I will be taking them to court over these charges or should I go directly now to Moneyclaim and begin proceedings.
I am thinking of doing the latter as I have read through A&L post and cannot see any success in sending the 2nd letter advising them of being taken to court?
Thanks in advance

Halifax PLC
Charges reclaimed £1802
Amount they paid £1550
Sent 1st letter middle of December. Had a general letter confirming they had received letter on 18th December. Had first offer of £1,074 on 11th December. Called them and negotiated to £1,550 on the phone. They are not closing down my account. I am happy to have not claimed all because I have gone overdrawn and had lots of unmanagibility around my account so I am happy to take responsibility about that. I had 56 charges and thought about £5/7 charge was a reasonable amount. I took the offer as well because it would take another £100 pound to claim, so all in all, I missed out on about 150 pounds. I am really happy with an unexpected lump sum that will pay for my wedding dress!
I was home with my daughter (who was ill) when I saw your article on Lorraine Kelly. Thank you so much Martin, I am a happy customer!!
Best wishes

sorry for repeating request but hoping someone can help because I want to get my court allocation form done and sent. 2 worries:
1. HSBC's defence is that my charges are 'service' charges, I also heard this mentioned on BBCs Money Programme. Is this a new trick they are trying, has anyone experience of this. My feeling is the charges are not service charges as they were added for exceeding my overdraft or card misuse.
2. Shocked that I have to pay another £100 to go to court but willing to pay especially since I can claim back if (when) I win. But, can the bank claim any costs from me. If so any ideas about what these could be?
Thanks0 -
Bank: Alliance & Leicester
Amount Claimed: £493.00
Amount they paid: £543.00 (inc £50.00 court fee)
The story
Sent letter from BBC website, to which they sent the response "charges in line with banking industry and as per terms and conditions"
Issued court proceedings, cheque recieved after 7 days from A&L solicitors, advising they didn't accept claim but mindful of additional cost incurred. It did say that "even if they do accept that charges did not represent the actual loss by a&l (which we don't) surely it cannot be fair to accept A&L to cover the entire costs!"
Basically an admission that the cost are nowhere near the actual loss of A&L, now going after MBNA for credit card fees
Does anyone know if A&L can make me repay personal loan and credit card with them as they no want to close my bank account?0 -

BANK: HSBC:
Amount Claimed: £3381.50
Amount They paid: £2832.75
They claimed I had already claimed £234, perhaps I had, but there is still a difference of: £314.75??.. but hey, I'm accepting the offer...
ALSO: The account is unused by me they had stopped sending me statements after September 2006. Thus the claim went up till then.
I noticed from online statements that up till now, I am incurring £30 charges per month, thus far totalling: £150, can I AGAIN claim for these as they were not in my initial case?
(This offer came after letter number two, threatening court action in words seemed to do the trick)0
