I read somewhere that £12 was much more of an acceptable figure for banks for charging (trading standards, i think). Well my question Is, can I claim back all the £10 charges of which, I have had upto 7 in a month, I could probably have paid them 2-3K over 6 years. Spent years getting my overdraft limit down to £250 and when I went over badly last month (first direct) I had one of them phone calls ''how's things going'' and "would you like a laon''. when I said no ta, they told me that if I reached my overdraft limit they may not pay the amount, well thank god for that. but then I have put a load of money in since. anyway my letters ready to go if anyone can answer my question. • Hi There
I have sent my 2 letters and LBA to HSBC for £3365. Started court proceedings 21.12.2006, HSBC defended claim via DG solicitors 24.12.2006.
I have had an offer for £2000, which I have formally declined.
I am due to go into hospital 17.01.2007 for an op and will be in for approx 5 days. Do I need to let the court or DG know I will be unavailable during this time?
I was hoping HSBC would have got back to me by now with a reasonable offer!!
Hope someone can shed some light.
    Cheers Roni.
  • Hello!

    This is my first post!

I have a question, i think i realisticly know the answer but i want to make sure.

I made myself bankrupt on 10th October 2005 and it ended last october. Or so i thought!!!! I have a whole story of trying and failing to get a bank account, if it helps anyone!

The reason for going bankrupt was after university and the charges the banks especially the Halifax applied to my accounts. I couldn't cope, i was 24 and do desprate that i considered many options, as i'm sure many of you have.

I was just wondering if there was any possibility of claiming back the charges the banks applied to my accounts as this was within the six year cut off?

    Happy Money Saving!

    This site is fantastic!

HI folks, my first post in the forums. My partner has an account with Nationwide, which went overdrawn as a result of a non paid direct debit which she thought had been cancelled. As she wasn't using this account there was only a matter of a couple of pounds in it. As it was, as far as she was concerned, unused she wasn't taking notice of the statements that were being issued. Eventually she received a letter from Nationwide claiming charges of £200+. We used Martin's templates and reworded them to reflect the difference with this claim. I.e. the charges haven't been paid yet. The replies from Nationwide state that they won't refund and/or cancel the charges. The next stage of Martin's claim is to tell the bank you are taking them to court to claim back the money. As we haven't paid the charges yet, does anybody have any idea what course to take now? Hopefully i've made this understandeable!
    Thanks in advance
    Fender6ix.

it doesnt make a diffrence if you still owe them the money they will just pay the money you are awarded into the account therefore void the charges.

I was going to send my letter to be "signed for" too because the bank have not responded to my first letter and I wanted proof of delivery. Silent treatment from the bank is a new one on me as they seem to love sending me letters normally. However I'm thinking maybe it's best not to use special delivery as it may cause the bank not to receive the letter as in the quoted example.

i sent all mine by royal mail special delivery and they where all signed for and had no problems a tip though is not to post it on a friday as the bank might not be open on a saturday to sign for it.
