Northampton is where MCOL claims start off from. If the bank enters a defence, when you receive the allocation questionnaire, the case will be transfered to your local county court. If it isn't, there is a section on this form to request the case is held locally to you.How many surrealists does it take to change a lightbulb?

Sent 1st 2 letters from template starting at the beginning of December and filed small claim (costing £120) after ringing the bank to no avail. Received letter this week making above offer. I am going to ring and try to renegotiate the full amount of the charges negative interest, as I have had to spend out on the small claim to get a proper response. At the end of the day though, the £250 shortfall equates to less than £6 for each time I have bust the limit, which I think is not bad. I can save money elsewhere by accepting now and am still over 1300 pounds better off than I thought I would be. As a newly reformed moneysaver this is the icing on the cake.:T :T0 -

Initially I wrote and asked for only two months charges back totaling £180 which would have brought my balance back to "normal". They then wrote a letter back refusing to refund any charges and threatening to close my account if it was not brought up to date. After phoning them they replied, '' we do not do refunds here''. So, I decided to take things further (after waiting a month for my last six years of statements). I sent them the first letter, as given in this website, and two weeks to reply. A month passed before I got a letter saying that they will be in contact within the next month. I Then sent them the second letter, which they didn't reply to for another month. By then I had already put in a claim at my local court. They replied by offering me just under half, which I declined. I then phoned them, in case I could change their minds by telling them I was taking them to court, but I couldn't. I was then given a court date. Barclays also sent me a standard issue defence form, but the day before the court case I was phoned and offered the whole amount and asked to fax them the acceptance letter as soon as possible, which I did on the day. It took four months, and a lot of waiting but in the end I had a great Christmas!!!! DON'T BE INTIMIDATED AND DON'T GIVE UP0 -

Sent later last October - Natwest replied 2 weeks later saying that they apologised for my dissatisfaction caused and that they believes their charges were fair, reasonable and transparent.
Sent 2nd letter on January 2nd by registered post (new year resolution was to see this through!) threatening to take them to the small claims court.
Yesterday, I got a letter back offering me £64.67 (to accept within one month), i.e. all fees without interest. It stated that this was offered as a gesture of goodwill and without admission of liability or error.
I will accept this offer and forget about the interest even though I believe they are legally required to pay this if I went to court. I will then close my account.
Many thanks again to Martin and everyone who has contributed to this thread, it was a mine of information and gave me the drive to do this.
My advice is that it pays to be tenacious, but be courteous, patient and confident that the law is on your side. :beer:0 -

They sent me one letter essentially telling me to go away, but when I threatened to take it court they settled 2 weeks later. Received the funds 5 days after that direct into my account.....

Having checked my records, I see that you did indeed refund the charge of £27.50 (taken on 23 February 2001) on 20 March 2001. I therefore accept your offer of £167.50 in partial settlement of this claim. Because my letters went unanswered, I commenced proceedings with Moneyclaim Online. Service of this claim was acknowledged by HSBC on 18 December 2006. I am also claiming for the £30 court fee and £77.99 interest.

HI folks, my first post in the forums. My partner has an account with Nationwide, which went overdrawn as a result of a non paid direct debit which she thought had been cancelled. As she wasn't using this account there was only a matter of a couple of pounds in it. As it was, as far as she was concerned, unused she wasn't taking notice of the statements that were being issued. Eventually she received a letter from Nationwide claiming charges of £200+. We used Martin's templates and reworded them to reflect the difference with this claim. I.e. the charges haven't been paid yet. The replies from Nationwide state that they won't refund and/or cancel the charges. The next stage of Martin's claim is to tell the bank you are taking them to court to claim back the money. As we haven't paid the charges yet, does anybody have any idea what course to take now? Hopefully i've made this understandeable!

first time posting ,i have read most of the treads and was just about to do the letter . when i thought why not give first direct a call as they are phone banking .i called and ask for a statment of all my bank charges .they said is it to claim your charges back .i said yes ! .they told me they would post them asap. saved a bit of time there . if i have done the wrong thing please let me know

The postie tried to deliver it at 11.01 am on the 3rd of jan no one was available to sign for it so he left them a card so it could be picked up from the local delivery office ( less than 1/4 of a mile away!). SO where do i stand?0 -
I sent all my letters to G E Money, Natwest, Birmingham Midshires etc Special Delivery and have not had a problem.:rotfl:
