    Very quick and painless experience - I began the whole process at the start of December 2006!!!
    HSBC didn't charge the £10 fee either, they sent back the cheque.
    I didn't get the interest on top, but I'm very happy - afterall I do appreciate that there is some cost to the banks of me not controlling my finances!
    Now awaiting replies from Citi cards and The Royal Bank of Scotland on behalf of my husband - they have both taken the £10...boooo.

    You can do either, recent thread gives someone who has won by going via the Financial Ombudsman.

    They have 40 days to provide the data information required.

    Amount Reclaimed: £301.00
    Amount they paid: £367.97 (S.A.R fee plus interest)
    The story: Basic really, 40 days to get DPA info back. Stuck to my deadlines. Filed at court. Halifax didn't acknowledge, so filed for judgement. Judgement granted. Halifax paid up the next day, missed £1.66 in interest, rang them, got that too.:D

    Amount claimed £945
    Amount paid £1000


    I claimed £900+ from Barclays and although it has taken since last July they have paid me £1000 today. They did initially offer me half but I refused. A court date was set and I recently served the papers I wished to rely on such as statements, copy letters etc as requested by the Court on both the Court and Barclays by the required date. They didn't serve any on me and the Court then gave them more time to do so. They didn't bother but offered me the full amount plus interest and court costs today.

  • I also recieved a letter from Natwest saying that they were sorry for the delay and that they will get back to me ASAP after recieving my letter, that was my intial letter, I have sent them the final letter and it has past the 7 days response time, they have just ignored my threat to take them to court!!! My account has a 300 pound overdraft limit, I am currently 290.00 into it, so i am fine. However unable or just plain ignorong my letters stating they do not have time, they do have time however for the first time ever since I have banked with them, and unusally about the time my first letter for claim was sent to them to send me 3 letters, saying my count was not usually ran like this and it is concerning them, they have sent 3 letters to that effect, the last one today up to now this is the 4th letter, however this one say's if I dont sort my account they will send it to a debt recovery agency??

    coincidence...?? that I started getting these letters since i filed for my money back??

    Well the last letter I sent threatning them with court in 7 days has been ignored, but me like a fool, forgot to send this one to my branch via registered mail.

    Anybody have any suggestions as to my next step? Also can i recalculate what they owe with interest everyday, for example can i re-enter the original figures in the moneysavingexpert calculator today, and send them the revised figure, or does it have to be the original figure at the start?

  • Follow your time scale and send the next letter if they have not replied in the due time.
    i have the next process is court action do you think sould give them the extra time or go on moneyclaim and do i add the court fee to the money they owe or is that done automatically.
  • If you end up taking the company to court, yes there can be additional court costs depending on the amount of the claim.

    If you are using the online system, use the registered address.

    but they are saying that i will have to pay there legal costs aswell and does the same rule even apply to mortgages because they are saying that there charges are in line with everyone else but charge me £50 for not paying by direct debit and £50 for paying late thats like £100 per month.and they dont seem the slightest bit worried ever other company so far other then argos have settled in full on second letter but they basicaly told me they will fight in all the way in court at my expess as they would add there legal bill to my mortgage account.

    If your claim is in the small claims track, you will not have to pay the banks court costs. This is a scare tactic to try to bully you. They cannot just take their costs from any of your accounts, only a judge can award costs, and they don't do this in small claims.

    Just because another company is charging the same unlawful amount of charges doesn't make it lawful.

    but can i claim agaist a mortgage company and could they try reposesing my house over it because it my current mortgage company.
