claims OVER £5000

I have read loads about people taking banks to court for less than £500 to the small claims, but not much if you wish to claim more, and certainly no success or failure stories, yet the GMTV site said there was a record of someone winning back over £17000... any news would help,
am currently trying to claim £6500 plus interest and have filed through the Fast track system, would appreciate any advice..stories.. etc:confused:

    There are various discussions about Fast Track cases on the CAG website.

    Basically, there shouldn't be problem unless you lose, only then would you be required to pay limited costs.

  • CAG is the Cosumer Action Group. Go to https://www.consumeraction.com and you will find all the info you need. I have to warn you that there's a lot of information to take in so be patient.

    I'm at Stage 1....where I've sent letters asking for statements for the last 6 years. I've already opened a new bank account with Cahoot.

  • I'm claiming £7.7k and have got to the point where I need to file my claim with the court as only been offered £2.5k at this point.
    Does that mean I cannot do it via Money Claim website due to the amount.
    Please advise as I am now very very confused and a little worried that I am proceeding rather than taking a guaranteed £2.5k...
  • I actually went to the court house and asked for advice, they were fab, it cost £250 to file the claim so fingers crossed, they have until this friday to answer..
  • Can you just go to the magistrates court and ask advice then or does it need to be crown court?
    And was that for a large claim?
    I only ask as I work opposite the magistrates court so would be easy to speak to someone there I guess.

    No, you can still use it, although since you are expected to include a list of charges (normally a spreadsheet would be used) and this can't be included in the MoneyClaim Particulars, I would always advise using an N1 form and submitting the claim in person at your local court.

    With an N1, you can expand on your Particulars of Claim and of course attach a list of the charges.

    This claim value would normally put you in a position of facing a "fast track" court hearing - if it ever got that far - but it is not a certainty. Fast track has a draw back in relation to potential costs for the loser, but there is one MAJOR advantage - that of Standard Disclosure.

  • it was the county court, they advsie you on what forms to fill out etc, they do not give legal advice, my claim is for about £6,700 plus interest on each charge totaling about £300+.
    The court advisor cannot give legal advice but I asked to go into a private room, (they should all have one) as I had my baby son with me, and she was 'offering suggestions' for me to decide on.. so I went with my gut feeling and did NOT specify an amount, I just say i would NOT be asking for anymore than £8000... hope this helps
