  • In fact a court official in Scotland told an MSE user recently they were quite happy to accept multiple claims and that to save time if it came to court they would more than likely all be heard together. Of course the limit for claiming in the Scottish courts system is much lower.
  • Does anyone know the limit amount for small claims court? My brother has just calculated (over two days) that he is owed approx. £6000 in bank charges! Would he be better off claiming less money back in charges?
  • Have an Account with Lloyds and just waiting for my statements to be sent, so that I may calculate my charges. Completley terrified as I expect my charges are in excess of £6K! I now dread the 1st of each month but I have at least £175.00 of bank charges!!!! With the amount im reclaiming being so high am I more likely to end up in court!? Does anyone the sucess rate of higher claims?

    Have opened a new parachute account with Halifax. Any words of encouragement would be highly appreciated :-)

    Hi all, I'm one of the hundreds of thousands that has been enlighted to the possibility of reclaiming bank charges by GM TV, I have started the process of trying to reclaim bank charges against two accounts with one Bank incurred over the past six years. I now have an exact figure including interest.

    If the potential claim is over the £5,000 limit of a small claim, can I for instance claim £1,000 for 2001 on a separate small claim, then £1,000 for 2002 and £1000 for 2003 etc etc?

    Any help would be greatly appreciated.

    Oh and thank you to Martin Lewis and all that run your site, this is a truly exceptional site.

    I would just break it into claims of £5000 otherwise it will cost you more initially and mean more work.

    So if you have £5000 total between 2000-2003, make this one claim, and then another claim for example £4500 between 2004-2006.

    the plan was to include the charge for the claim in with the "to be claimed amount", I'm hoping this is ok to do.

    My wife has charges totalling £6250 against lloyds tsb...

    We have been through the first 2 steps on the site and had no joy, so we are at the stage of taking them to court.

    Please can someone guide me as to how I do this, as the value of the claim would be over the 5k threshold for the small claims court....

    Should I use a solicitor? Is there an easy way of going about it?

  • Because of this fantastic site I was galvanised into action to reclaim my bank charges over the last 6 years. After sending away for my 6 years worth of accounts I was utterly gobsmacked to learn the Abbey has taken 10,790 quid off me because of bounced DDs etc - (I'm a self-employed writer and my income can be rather irregular.)

    Anyway, I've started on the journey to reclaiming, and have used the first template in Martin's armoury, sending the initial letter off about 10 days ago. This morning I got a letter from Abbey, which I'll transcribe here:

    Dear Mr & Mrs Smith

    Thank you for contacting us and I am sorry that you have been so unhappy that you have felt you must complain.

    One of my team will be responsible for investigating your complaint and I have enclosed or complaints leaflet, which explains our procedure for doing this. High quality customer service is is of great importance to us at Abbey and we will do everything we can to reslove your complaint in a timely and satisfactory manner.

    I know it is important to you that we resolve your complaint quickly, but we want to complete a thorough investigation and sometimes this can take time. If we have not contacted you before then, we will write to you in four weeks to let you know what is happening.

    If you have employed someone to handle your complaint on your behalf, please note: employing a third party complaint-handling firm, or a solicitor, or financial adviser does not affect how we review your complaint. Please be aware that:
    *Abbey does not charge you to investigate your complaint
    *Abbey will not be liable for any costs incurred if you do decide to employ a third party.
    * Abbey, in general, will only make payment directly to the account holder(s) if your complaint is upheld and redress is due.

    Although I do not know what the outcome will be, I do hope that we will be able to find a solution that you are happy with.

    So there you go...one thing that does worry me though, when the investigating authority suggests next month a more reasonable figure of 15 pounds per charge, will the Abbey hold out until then to get out of repaying the full amount? Anyone have any idea?

    I'll be posting here regularly to keep you up to date on the proceedings.

    I'm so sorry to jump in without searching but sheesh! This forum is a busy thing to navigate and I am a computer dullard....:o

    I've got £11884 to try to recover from Nat West and they've had the first two letters and a threat of court action. I didn't realise it was only £5000 limit though. I've tried to find what to do above this but as I say my eyes are starting to bleed! Be kind to me...:o

    They are currently ignoring my last letter sent on 16.01.07 after sending a polite letter on 30.01.07 saying it was going to Customer Services but after two faxes and a 'please reply by return' I've heard nothing....
