Wow thanks Rex that's a HUGE glimmer of hope! At one point my partner was being charged a whole weeks wages a month for being overdrawn and missing DD's.0

I have a claim against Natwest for £5.5k (without interest). The initial 14 LBA request has been ignored, so next stage is to look to the courts.
I read that if the claim is greater than £5k then the court process is more complex. Can someone shed some light on this and are there some serious pit-falls to watch out in this situation. Is the filing process different.

I am a complete newby to this site, but have heard so much about it all that just before christmas I sent for my statements(only to find I had about 5 months missing from the whole six years and needn't have wasted my £10!!)
Any way totted up charges and sent the first letter.
My total charges are £ 5158! ( yes I know. 2005 was a really bad year!!But it was charges on charges that ate my money making it impossible to meet my bills and therefore more bounced etc etc, you know what I mean I am sure.) and the interest is £963.59.
Today I had a letter from the shAbbey (Ithink this is an appropriate name, thanks to whom ever thought of it!!) saying that they will cancel as a good will gesture(!!!???) £440 of charges of which some are yet to be debited to my account!!!
So I have today replied with my THNAKS BUT NO THANKS letter.
What I would like to know is has anyone pursued a claim for more than £5000 and are there any different rules to getting paid or should I drop to £5000 + interest (yes I am gready, but after all it is MY money!)
If any one has any advise to the larger claims, please let me know what you think of this...

I have totalled up my charges from Abbey for the last 6 years and to my horror my charges come to over £5,000 without interest and over £6,000 with interest.
From the advice I have read if it gets to the court stage then for me to take it to a small claims court the amount claimed has to be under £5,000. So should I reduce my amount I am claiming so that I do take it to a small claims court or is there a different course of action if it is over £5,000??
If you have been successful in recovering a claim of this amount I'd like to hear from you.

I have sent my LBA, and recieved the standard reply, and 7 days were up yesterday. Because my claim is over £5000, do i need to split it, read on here about fast track, but it appears that the most tried and successful way is to split.
Now i am confused do i split it to near £4999 mark, and then claim for the remainder at the same time, or once the first claim had been sorted do i start the process all over again? Looked through the forums, and not found any information on this, could anybody point me in the right direction, or offer any advise on this, perhaps from experience. My bank is A&L.

You can split your claim into two dates so that each claim is less than £5000 before interest is added. (2001-2004....£3000, 2004-2007....£3000)
If the amount you are claiming is only a little bit above £5000 before you've added the interest, you could ask that your claim is dealt with in the small claims track. The judge has the power to decide on this at the allocation questionnaire stage.How many surrealists does it take to change a lightbulb?
