    Do I have to split it into year order as you suggested, or month by month.
    I was thinking of doing 2000-june 2006, then the rest seperately

    I would chance that as one claim and ask in the allocation questionnaire to go to through the small claims track. There is no guarantee this will happen, but it can be allocated to this track.

  • I have just joined the site about a month ago and made it my new years resolution to take my bank the Natwest to task over huge charges they have made to our joint account over the last 15 years. Long story..... but we went through a sticky patch financially having kids, my losing my job, etc. etc. and regularly ended up going overdrawn with cheque return fees, referral fees and card misuse fees but the Natwest always kept letting us run up these charges because they were making huge money from us. We took out two loans with them each time to clear the last overdraft, which they had added to extensively by increasing charges over 6 years, after all they were huge amounts of money from us at a time when we could ill afford it. I have a selection of Card misuse fees, unpaid cheque fees, unpaid standing order fees, unpaid direct debit fees and what they call Referral fees every single month, sometimes several in one month. I have just received my last six years statements from them, but the pack was so huge, it fell open at the sorting office and everything must have spilled out because I had it delivered today in a plastic bag from the post office advising the item had got damaged in transit. However, tonight after spending 6 hours going through all the statements, I find that exactly the last 12 months statements are all missing. They have either only sent me the last 6 years bar the last one i.e. January 2006 TO Jan 2007 is missing, or somebody at the sorting office has stolen them i.e. identity fraud perhaps to watch out for. I have compiled that over the last six years the charges come to just under £11000 pounds, and I havent even included in that amount the charges of £14 per month for unauthorised overdrawn fees. Ive only taken account of CARD MISUSE FEES, REFERALL FEES, UNPAID CHEQUE FEES, UNPAID DD AND SO FEES and odd looking account charges of £28 per month even when we were in credit. Has anybody taken Natwest for this amount so far, and if so what was the outcome like, and where do I stand on taking them to court to get the money back, I think I have been fair by not calculating the full amount bearing in mind we were unauthorised to be overdrawn and they have charged us those fees which Im not claiming, just the others. How do I go about taking them to county court for this kind of cost. Does anybody know or can help with advice in this regard ? I really dont know where to start on this. I am happy to throw more money at this to get my money back, as financially we are sound now and have been for the last 12 months. I just need to know if I can do this myself or do I need to take on a solicitor etc.

  • Basically you need to go back to the bank and ask for the missing statements, although they can been sent out in batches so perhaps some are still to come if they are still within the 40 days.

    Then you follow Martin's article and use the templates and calculator.

    No point in worry about going to court until the first couple of letters have been sent out. Although you can see from the previous posts here that larger claims can be made.

    I wonder if there is anybody out there who could help with my question. I have followed all the steps so far with the standard responses from Nationwide. I am just about to post my claim to the courts via the internet but I am having trouble working out the interest part of the equation. My total charges come to £5123.00 without interest, I am claiming £4750 to keep it in the small claims court. How do I work out the interest for this? do I just start with the first charge and keep going until I reach £4750. Sorry for dumb question but at this stage I want to get everything right.

    I filed my claim through MoneyClaim online - they have a higher limit for claims. Regarding your question - yes, I would start with the first charge and keep going till you hit the limit, and then file. Repeat! Might be worth doing it through Moneyclaim though - means you only have to file once.

  • Hi there I have a Nationwide account where I have been charged £5800 over the last 6 years.

    I have reduced the claim to £5000 to bring it within the small claims criteria.

    I then added interest which adds another £1100. i filled the total claim amount as £6100. is this still eligible for the small claims procedure as Money claim wants to charge me £250( i thought £120 was the max??)

    I do need this to be a small claim as i am worried about my liability of going through a county court.

  • Have a read of the previous posts, as you see you can split the claim.

    The £120 charge is up to £5,000, £5,000.01 - £15,000 is £250.
