Claiming £3054 back from HSBC. Got as far as online claim and bank have now filed a defence. Can anyone help with the following?
Form from court tells me I have to pay another £100 fee. I've already paid £120 to online court thing. Will there be other charges? Can the bank claim any costs?
HSBC's defence is that the charges to my account were not penalty charges they were 'service' charges. Is this a ruse to get round law? (I'm puzzled how £30 'misuse of card' charge 3 times (etc) in one day can be a service ...

I put my claim into the court on the 5th of January against Alliance and Leicester received a cheque today 12th January for the amount I claimed £298 really surprized it took so short a time. Thank you Martin for all your tips just waiting now to see if they close my account as they have said they will be in touch about discussing how I operate my account as I do not agree with thier terms and conditions. I have already in the proccess of opening another account so they can do what they like.:T

A cheque has arrived today from Optima Legal Services on behalf of Alliance and Leicester, paying me the full amount of my claim - £180.16.
Thanks, Martin, and everyone for all your help and support - I never would have had the nerve to do this otherwise.
Just one query - if anyone can help - I did the claim through the HMCS Money Claim Online but can't seem to see where to withdraw it - does anyone know, please?0 -

I could not find out either as every time I tried to do it via web site it would not accept it. I phoned the court and they accepted it over the phone.

I posted a while back about Nationwide and I sent my 3rd letter and after 2 weeks heard all I got was a letter saying they were passing it to someone else. I decided to give them another couple of weeks and heard nothing so sent them a letter stating I will be pursuing a court claim against them. I left it til after xmas to see if this may prompt them in to offering anything and got a letter back saying they believe they have acted fairly blah blah if I am not happy then to take it to the financial odbudsman (I know I have spelt that wrong). Shall I pursue the court case or go to FO? I think they are also gonna close my account should I win - anyone else found this?
O 1 last thing how long do banks have to send you all your statements under the freedom of information act?

mint paid after 2 letters and a phone call £190+ intrest did try to offer less but after i said i wanted all of it they paid
rbs mastercard paid after 1 letter ad a phone call £250 + intrest again tried to offer les said no want whole this and they paid.
HSBC paid £480 after 2 letters but didnt pay intrest.
Creation Financial Services Ltd (store card) paid £210 + intrest after 2 letters offered less after letter 1 said no then after second letter paid all.0 -

Refunded £495
Paid up after first letter requesting refund. Said will not entertain refunding interest. Happy with this result - didn't feel that going to court for £106 was worth it. Let's get stuck into them!0 -

Amount They Paid: £1600
Story:
Already had statements for last 6 years, and charges added up to £1716, so sent first letter on 19th Dec 2006, and recieved standard reply saying sorry I was unhappy etc dated 21st Dec 2006.
Sent 2nd letter on 23rd Dec 2006, and recieved another standard reply, stating my letter had been passed to Customer Relations Dept dated 27th December. My second letter gave them 7 days before I went to court.
I have not gone to court yet, as I was
waiting till next week till I could aford the court fee.
A pleasant man from Halifax has just phoned me, and said Halifax are NOT at fault, and the OFT guidelines apply to credit cards only (haha, I read lots about this not being true here). He asked what grounds did I have for thinking the charges were unreasonable, and I said that the costs to Halifax of sending me automated letters are not proportional to the charges levied. He said have I been researching on the internet, to which I replied yes, and he said that although the Halifax were not at fault would I accept a goodwill gesture of £1000, to which I replied I could not accept, and would have to proceed with court action. He then immediatly said would I accept £1600 - I said yes I would accept this, and he said he would send me the acceptance papers and I would be credited within 7-10 days of recieving the signed acceptance papers.
I know this is £100 odd short of the total charges, but it will really help me out at the minute, and being as I thought I had lost the charges forever, it's not like I've actually lost anything, and it saves me having to bother with the court - I could have got a extra £300 in interest if it went to court too, but £1600 this soon after xmas is a BIG bonus.
The man on the phone did say that this would be full and final settlement etc, and that any further charges WOULD NOT be refunded, I replied that I would be taking steps to not have any more charges applied in the first place anyway. Just need to decide now if to continue banking with the Halifax or start using my parachute account at Yorkshire Bank.

I've been a semi-lurker on this site for ages - so I thought I'd add my two-pennies-worth on my reclaiming bank charges back success...
I've had 2 back from the bank (HSBC, a joint account, and a single account) paying back the charges in FULL at the first attempt totalling: £2100.00.
I have another 5 charges from various credit cards and a couple more bank accounts to claim from, so hopefully they'll do the RIGHT thing and recharge the charges in full. This would bring the entire total to well over £3000.00.
Many many thanks to this site, success stories, tips and ideas for the inspiration in going ahead and reclaiming back some charges.
Cheers once again - and if there are still people out there who are not sure whether to go ahead - DO IT, and DO IT NOW!! Get your money back.
