    Have received a reply today from Bank of Scotland to my 2nd letter saying it will take 4 weeks to respond to my query. Having read the thread it appears I should just go to court tomorrow (7 days is up then) as their time is up.

    My claim is for £4650 plus interest which takes me over the small claims limit. Should I write and offer 'early settlement without the interest' or just go straight to court? In which case is it less risky to drop the interest and go through Moneyclaim or wade through a High Court claim for the interest as well?

    I have also incurred charges over the last two weeks of about £100 -when can I add these to my claim?

    Thanks for any help anyone can give...

    The small claim limit in Endland is £5000 before interest is added. Add the latest charges to the court claim.

    I would go ahead and issue the court claim once your dealine is up.

  • CAN ANYONE HELP
    I sent first letter to my mortgage company to reclaim non DD charge of £50 a time and late payment charges of £50 a time on the first letter they basicly said there charges are in line with everyone else, and would not refund anything i sent them second letter and then they said that they still stick with there first letter and that if i want to take them to court that is within my right and send them the summons but i will incure additional legal cost on top of what ever i owe them does anyone know if this is true and has anyone took a mortgage company to court any advise and they also told me to send the summons to there po box trading address not the registered address any advise on this aswell.

    I recently issued a claim for bank charges. The amount I am claiming is £3500 inc. interest. However I have just received a reply from Halifax. They have offered me £1253. As you can see, this offer is way under what I am owed. Please could someone give me some advice, as the clock is ticking. I have 2 weeks to reply. Thankyou.

  • Only you can decide if you want to accept or proceed with court action. You can reply saying you will accept this as partial payment and will be going ahead with court action.

    Has taken 3 months and three letters, but have received payment today after threatening court action. Have not even been asked to close my account (although I will when the money has cleared)

    AMOUNT REPAID £2,153.00

    followed all advise on site and in just under two months got all my charges back plus extra for exspensives........ then got letter a week later saying closing my account on 25th jan 2007. but i d`nt give a dam.:beer:
