    I defended myself on a traffic violation years ago when I was only 25. It was absoutely fine. The judge put my argument into legal terms - 'so you are saying it was an act of god?' Surprised me 'Yes'.
    My partner, now, is a lawyer and says magistrates and judges get people representing themselves all the time. They will appreciate it if you are organised and to the point.

    Have all the papers in order and summaries of what you need.
    Mentally rehearse what you will need to say - if anything? Do you know? Perhaps others could tell you that. Ask again for experiences in court.

    you may have to register but its free and easy, scroll down to SECTION G and there is text there for you to copy.

    Something like:-

    I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument.

    However, the continuing problem is (in common with the 100s of other cases currently being brought by other bank customers) that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith.

    Accordingly, I would respectfully ask that the court in this case, not withstanding allocation to the small claims track, order standard disclosure. I understand that it is in the courts discretion to do so. I believe this would bring a rapid end to this litigation.

    The story:
    It was a relatively small amount (lots to me though!) incurred when I was at college, so I simply wrote to ask for the charges back, and within three days, it was in my account. Thanks to everyone who works so hard to make these things happen.

    I shouldn't reply on this thread but I wanted to say thank you for your comments, much appreciated :D

    I saw this thread and started to read it and was shocked what the banks are getting away with so i had a look online at our bank I notice that over the last year we have missed a few direct debits and was charged £25-30 a time and then a £20 unauthorised Fee could i claim these back some weeks like at the start of the month we have lost a weeks pension due these charges, My mum is 70 and is disabled and gets her pension credit weekly i have given up working to look after my mum and get carer's allowance and Income support.
    My mum's account is with Nationwide which she has had since Dec 2004.

    I am new to this site and finding it really interesting. I have already claimed £750 from the HSBC very quickly and successfully but now i am slightly scared and could use some advise please.

    I am wondering if anyone has had a positive experience with the Abbey as I have sent all the relevant letters and the last one i got said "fine, take us to court". I haven't yet as i am concerned as to what the risk to me may be if i lose. :think:
    The claim is for £1700 so no small amount. I don't want to wimp out after all this and let them get away with it but neither do i want to end up with the possibility of losing and in more debt than i am already in. Also will i have to appear in court personally as i am not very confident with that sort of thing. I wouldn't know what to say. Any help/advice will be greatly appreciated.

    I have been offered , in writing , half the amount I have put a claim in for .
    I will be accepting this ( £700 ) on the grounds that ,although the charges are now deemed "illegal" , it was my fault that cheques and dds were returned . It is also £700 i thought i would never see again so £700 better off !! . I also have a good relationship with my bank and these charges were accrued from an old account which is now clear and my current business account witht his particualr bank is healthy .
    ........ however I shall show no mercy for other bank in question !

    Hi,

    As it stands at the moment, there is a very low probability of you actually having to go to court. The vast majority of banks that actually do submit a defence, settle before the actual court date.

    That being said, you need to be prepared just incase it does go all the way.

    Everything that you need to know has been asked/answered on this website, so if you have the time, read through and you will have a great idea of what you can expect.

    My personal view is that £1700 is a vast amount of cash and well worth the input.

    I've just raised a claim against Abbey/Cahoot for a lot less (£550). They sent me the default letter saying that they will give me nothing. I do not buy their "hardball" approach and will not settle for anything less than all of it.

    What have you got to lose?

  • I am claiming from Halifax Visa on behalf of my daughter who is a Uni. student, they provided me with the statements and I worked out the claim which amounted to £207 and sent off the letter requesting settlement with 14 days. A letter was received back from Halifax thanking her for the claim, but, "In relation to the recent statement issued by OFT, Bank of Scotland has agreed to reduce their credit card fees to £12. This took effect as of 1st August 2006. The fees you were charged were in line with the Ts&C's of your account and in view of this, we will not be refunding any charges applied. Up until 1st August, existing terms and conditions still applied."

    I have completed the County Court form and sent it off to the Halifax claiming the full amount giving them 7 dyas to respond positively.
