Bank: HSBC/ first direct
Amount Reclaimed:£1530.05
Amount they paid: £1530.05
The story: Sent the first letter on the 7th December 2006 requesting statements. Was first offered £1090.00 plus they said my charges amounted to £1273. I replied back highlighting and numbering all the charges and demanded my money back plus interest within 7 days or I would go to court. Received an offer within 3 days for the amount owed.

We are with Intelligent finance which whom we have a mortgage and bank accounts with.
We are overdrawn by a fair bit on our bank accounts , and in the past we have incurred late payment charges etc .
Is it wise to go ahead and try and claim back all these bank charges whilst overdrawn ??
Thanks in advance.0 -

You can go ahead with your claim, but there is always a chance that your bank will withdraw your overdraft facility and demand repayment of any outstanding overdraft. How many surrealists does it take to change a lightbulb?

You can claim these charges. The OFT have said that any charge over £12 they would consider unfair. They also said a charge would not be considered fair just because it is set at £12 or under. Only a court can decide for sure. You would need to follow the steps in Martins article to reclaim these charges. How many surrealists does it take to change a lightbulb?

I've already reclaimed some charges from Halifax and have embarked on my second round with them - they don't learn do they
This time though it's a bit different - I'm claiming charges from a joint account I held with my ex. He refused to sign to take his name off the account so it's still in both names. However, as either account holder can sign for transactions - and he took money out of this account and Halifax basically told me where to get off - I thought I'd give it a go.
After my preliminary letter they made a "goodwill" gesture of £1382 (I'm claiming £1696), but because they said they couldn't contact me (didn't try very hard) they rang him and told him all about it - he now thinks he's getting half  (but as he owes me £3500 in child support, not if I can help it).
Sorry, I digress. My question is, as I'm about to start court proceedings as the sole claimant I hope they have to deal with me alone - am I correct in thinking this, or will they argue that (as a joint account holder) he's entitled to half?
Apologies for rambling onI've tried almost everywhere to get an answer on this without much luck - so I hope someone can help

Hi Guys,
need some help!
I bank with Barclays and have started the process to reclaim my money, in total £1290 or £1485.44 with interest. I wrote the 1st letter to the bank asking for my money bank and they responded within a week saying they are willing to offer £500 as a good will gesture in which I wrote back saying I wanted the full amount otherwise I will take them to the small claims court, I gave them 7 days to reply. I have just recieved another letter from them saying they are willing to up their offer to £650 which I am going to refuse as I want the full amount back but just wanted some advice on how to do this, should I call the guy at the bank whose name is on the letter and discuss it with him and let him know that these charges have given me bad credit and me and my family bank with barclays and we were thinking of closing our accounts, or should I write back or just file a claim through the courts??0 -

i think i might have make a balls up!
i sent my first letter in and now i relise i have missed a charge off ! Its for £100
can i add this to my my second letter? ( due out on friday if i get no reply)
Is the 14days 14 working days or just 14 days?
thanks JIM0 -
Don't phone them, do everything by writing. If you want the full amount back you have to follow the next step and start the court proceedings.0

Getting exciting...
Have received a reply today from Bank of Scotland to my 2nd letter saying it will take 4 weeks to respond to my query. Having read the thread it appears I should just go to court tomorrow (7 days is up then).
My claim is for £4650 plus interest which takes me over the small claims limit. Should I write and offer early settlement without interest letter or just go straight to court? In which case is it less risky to drop the interest and go through Moneyclaim or wade through a High Court claim for the interest as well?
I have also incurred charges over the last two weeks of about £100 - can i/should i add these to my court claim?
Thanks as always for everyone's invaluable advice and support.Lou0 -
Ok cool thanks.
How do i start court proceeding and how much does it cost?0
