After bank told me they would not be paying me out I sent the next letter that I would be taking them to court advising them they had to respond within seven days. This being the seventh day, they have sent me a letter saying :
" I refer to your recent letter and as requested I have reopened the complaint and_a further review is being undertaken.
My understanding of the further issues you have raised are as follows:
• no refund of charges levied to the account
I hope to respond to your complaint shortly, at the latest within the next four weeks, once I have had the opportunity to review the above.
Please be assured that every effort is being made to bring your complaint to a satisfactory conclusion"
I never asked them to "reopen" the complaint, is this just another part of the tactics they use? or are they killing time for some other reason? lol.In the letter I had sent to them I stated that:
"I look forward for a full response to this letter within 7 days; otherwise I will commence court proceedings to reclaim my money"
What do I do now? They have had more than enough time and have waited till the last moment to answer me. I just want to try and stay in front of them(if we ever can). Any advise ?0 -

For those in Scotland and Northern Ireland, while the law is similar, the small claims process works differently. In Scotland the maximum claim is £750 and you may only reclaim 5 years' charges, in Northern Ireland the maximum claim is £2,000. Thankyou so much for your help. I was hoping I could send them another letter telling them they had had seven days as I'm a scaredy cat but as it's went this far..... Scottish law says I can only claim 5yrs back, I'm wondering why the bank has not stated this! They gave me the 6yrs statements, you would think they would know it can only be five wouldnt you? Just goes to show they are not up to date with a lot of thing's huh?. Anyway thanks for your help once more.This site has got to be thee best.0

Arrears are irrelevant and will have little bearing if you go to court.
The issue will be unfair/unlawful penalties to your account.
The common opinion is that the only legitimate defence is for the banks to produce documentation to justify the amount of the penalties, which is something that most simply cannot do.
However, they may close your account.
Read up, weigh up, steam on!!

Hi All,
A piece od advise needed from anyone...Here's my story,
I had put a small claim back amount of 76pounds from HSBC.I first wrote them a pleasant email and they as a courtesy refunded me 25pounds.Then I sent them the first letter and now I have received a reply from them in which they are offering me another 25pounds.They said that thats the maximum they can offer and I have to send them an agreement for this and thus closing the case.
Otherwise they have written that the following t&c applies,
"A fee is payable for overdrawing service,.The circumstances in which fee will apply are clearly set out in our Personal banking t&c that you were provided with a copy when u opened ur account.If your claim for a refund proceeded to Court,we therefore believe we would successfully resist any legal challenge in relation to these fees."
Now I am bit confused...what should I do next?Should I take the 51pound offer or not?Is it worth fighting for another 25pounds?What should be my next step?

Well done for getting the £50 from the bank.
As for the other £25, my opinion is that it is not worth the time/effort involved in going to court for that amount.
Going to the small claims court has been made simple by this website, however there are some things that cannot be done for you and will take time and energy.
I personally would not do it for £25, however that is you're choice to make.

This is just a quick thank you note for Martin, & GMTV for telling us all about the unfair charges and how to claim them back. :A
Ive been with the HSBC bank for a few years now, and they have been fleecing me for most of them. However, i followed the step by step instructions on this site and,' hey presto,,' this morning i recieved a letter from HSBC, saying although they do not admit any wrong doing on there behalf :rolleyes: , they were prepared to settle out of court and pay me £1,756 of the £2,238 that id been wrongly charged over the last 6 years.

This is just to let everybody know that i have just recieved my bank charges back from Natwest Bank.
Claimed £2,500.00 and amount was paid in full as a goodwill gesture. I wrote to them asking for my 6 years statements and then again asking for the charges to be refunded with a detailed list of charges and received a reply within 14 days with offer.
Im so pleased i did it, it was well worth it. Thanks to this website's standard letters and forum with loads of help & advise.
