Hello everyone, I'm a newbie to the message boards so
apologies if my question is a daft one...
Having found ourselves spiralling into vast debt primarily
through our bank charges we decided to take action after reading Martin's excellent site. Our situation is that all our money now goes on charges and we often cannot pay the mortgage on time - all other items (food, family clothes)
are bought with the overdraft and further debt.
We claimed unfair charges from Abbey via the local court and they had until 28th December to reply. Abbey is one of a several banks we would like to make claims from.
They have filed an acknowledgement and intend to defend all of the claim. However, it is dated 3rd Jan 2007.
Haven't they missed their deadline?? Apologies again if
this is a laughable question but any help would be appreciated!0 -

I'm not 100% on this, but I think that you should have completed the next step on claim online as soon as the deadline had passed. I was waiting for Cahoots deadline to expire (today) so I could proceed to the next stage (request a win by default) however they acknowledged the claim just in the nick of time. Now they have 28 days to state their intentions
Stick with it though, it just means that it will take a little longer

grrrrr! i changed my mind, i will look for a different account to replace the one i have with the halifax but it might take time to find somewhere to shift my 3k overdraft debt to. mind you their overdraf charges have gone up to 15.9% this month and it's even higher for people who don't pay in a grand - so putting the 3k onto my credit card is probably not much more expensive.
they paid my british gas direct debit. it used to be 35 and they put it up to a hundred but i called them and thought it was being sorted out. to pay this hundred ponud direct debit which put me £40 overdrawn the halifax are charging me not once but twice - £30 for them paying my direct debit and then another £28 because it took me over my overdraft limit!! why charge twice? i was £40 overdrawn for just a day. i'm so angry!52% tight0 -

thought about accepting but since there have been another £275.00 of charges debited since 27th December have decided to refuse and re-calculate
Have told them willing to accept £950 using a modified version of the 2nd letter template. Only in this mess because I have been off work since end of October, but they're not interested in that.
Will let you know the outcome.

The Story:- I cannot believe how easy it was to claim back all of the charges. I sent the first letter requesting a copy of my statements for the last 6 years on the 24th November 2006. They arrived on the 5th December. I then sent a letter requesting all the charges to be repaid on the same day the 5th December. A letter then arrived on the 28th December offering me a full refund which i immediately sent back by return of post accepting their offer. They paid the full amount into my account on the 29th December ....The whole process took exactly 5 weeks from the 1st letter to the money in my account. What a wonderful start to the New Year.0 -

Hi Guys
I'm currently claiming back £3000 from Natwest. They initially ofered me £1500 as a good will gesture which i declined. I have since started the small claim process and the Bank have just decided to defend in full. I'm a little nervy about this and would like any advise anyone has to offer on what I do next. I beieve a i get a Q&A form to fill out from the court? also, has anyone heard of the banks actually going to court with someone yet? I'm hoping they're just bluffing me.

Can anyone advise with this one? Last September we applied to our Bank to reclaim unfair charges but it was for a business account. They eventually replied in detail but refused to refund anything.
Can anyone advise if a business account is somehow different from a normal current account, as we would like to persist, but if we are flogging a dead horse it won't be worth the effort.0
