Bye right they have to send you your statements if you want them because they may be hiding something you are not ment to see

Would I send the first letter again then or just plainly ask for my statements over the past 6 years? Wont they think its strange I am asking again or be awkward after threatening them with court? I suppose there's only one way to find out!
  • Martin does suggest though that you add the interest in at the start...

    Charge interest on top
If you won via the courts, you would be entitled to add 8% interest (not compounded) on top from the date you were ‘first deprived’ of the money (i.e. the date of each charge). Therefore you may want to ask for the interest as part of the initial claim. It's important to understand that you are not legally entitled to interest unless you win in court, yet all prior letters are a tool of negotiation; think of it a bit like haggling.

You may get lucky and get the interest on top, but even if not, the legal feedback I've had is that it’s one route to pushing the bank to settle quickly so it can offer to pay you without the interest. Of course there is a risk that asking for too much makes them less likely to settle too - sadly this is an art not a science. This isn't an easy concept so I've recorded a quick audio file which may help explain it.
For those who do want to ask for interest, I’ve had the calculator below specially built to work it out for you and included it as an option in the template letters later. However, if you'd prefer to play safe simply ask for the charges without interest in the early stages.

Which is why I queried it

Going back to your post you asked if people were claiming it and the next poster said you couldn't and so my post was pointing out that you could claim it at the first letter.

However... if they make an offer before going to court stages the banks won't include interest.

    :D
  • I'll do it without the interest I think.

Also have people been using the first claim letter on here or CAG which seems a rather long letter?

Both the template here and at CAG will work, and both mean the same thing. It's your choice.

  • its a shame I can't claim the interest as I'm currently adding them to the spreadsheet and its already £169 + £54 interest

But the point is you can add the interest just don't expect that it will be included if the bank make you an offer :)
  • CAN ANYONE HELP- DOES ANYONE KNOW WHERE I CAN FIND OUT ABOUT THIS
I sent first letter to my mortgage company to reclaim non DD charge of £50 a time and late payment charges of £50 a time on the first letter they basicly said there charges are in line with everyone else, and would not refund anything i sent them second letter and then they said that they still stick with there first letter and that if i want to take them to court that is within my right and send them the summons but i will incure additional legal cost on top of what ever i owe them does anyone know if this is true and has anyone took a mortgage company to court any advise and they also told me to send the summons to there po box trading address not the registered address any advise on this aswell.

Oh god I am confused now!! Every where seems to state don't claim it but are people claiming it straight away.

Also I have just come accross a part that I remember. I remember going into the bank and kicking off and seeing the manager after being charged two £25 referral fees. I remeber getting these refunded but it isnt entirely clear when the refund was made although there is a line saying £50 credited but it says - "601515 28jul 1019 card 02"

That makes a lot of sense doesn't it. Should i ignore this and carry on anyway as it was back in 2003
