Anybody have any suggestions as to my next step? Also can i recalculate what they owe with interest everyday, for example can i re-enter the original figures in the moneysavingexpert calculator today, and send them the revised figure, or does it have to be the original figure at the start?

Go ahead and issue your court claim. Re-enter your amounts in the calculator to get up to date figures for interest when you issue your claim. You need to put the total (including interest) in the claim form.

  • HSBC - Amount claimed £480 + interest they paid £480 after 2 letters

RBS Cards - Amount claimed £250 + interest they settled in full after 2 letter and a phone call they tried to offer less twice I said no so they settled in full.

Mint Card - Amount claimed £190 + interest they settled in full after 1 letter and a phone call again they tried to offer less but when I said no they paid in full.

Creation Financial Services Ltd (store card company Duet Card) settled in full after 2 letters again tried to offer less after fist letter then settled in full after second letter.

both mint and RBS cards tried to say they will pay the difference between the new £12 charge and there old charge, then they tried to settle without the interest but I stuck it out and phoned them before court action and told them that I am doing them a favour by phoning them and that I was trying to save them money because if I take them to court they will loose and they will occur court costs and additional interest but I not bother if they agree to settle in full with me today you try this you need to speak to a manager.

Stick it out and good luck everyone.

nearly £2,600 incl interest and court costs
had the cheque come 12/jan/07 from their solicitors
after them telling me i wasn't entitled to any refunds
had to go to online court and paid within 5 days of starting court action.

    good luck to others

i started my reclaiming back in oct and they took as long as they could.
don't be put off trying and if they won't refund money first or offer a small settlement, you know when it goes to court you will get interest on top of your claim!!!!

As a 'gesture of goodwill' after all the spiel about how they think their charges are fair, Capital One paid up [not that it's a lot compared to what others have to come back, but... ^_^ One more for the successes]

Natwest sent a letter too today [after one on Thursday saying they'd recived it, and they will get back asap... etc] and I got all excited thinking it was a decision but it was something about a saving account. but there's always next week ;)

    Thank you to everyone :)
  • Took a punt on trying to get Halifax to refund my 1500 worth of charges.

They sent a letter back offering £666 (is there a hidden message in that) which was tempting as it would have hit my account just in time for Christmas. But I'd become more militant by then so decided to go to court. Filled in the forms. Got a letter from the Court saying they were going to contest it. Was doubting my decision to go to court at that moment. Not for long. The next morning a letter from Halifax confirmed they were going to settle in full becuas eit wasn't worth pursuing through the courts - £1911 going into account in next five days if I call off the action

Have started my wife's appeal to Nationwide for £1400...they've said nothing on offer so am at jsut sending off letter before action.

Awaiting statements from Barclays, Lloyds and Abbey before going through process with them. The good thing is after Halifax paid up I've got the spare money to take the rest of them to court too if neccessary.

THANK YOU THANK YOU THANK YOU. What a brilliant start to 2007

    curious ....
on old statements that people have been recieving from banks , how do you set apart normal o/d interest from unauthorised o/d interest ?? . On my statements there is a differentiating amount that hs been taken off each month ( according to my balance ) . However I can only assume that is a mix of normal o/d interest at x% added to unauthorised o/d interest at 29.5% as the annual amount of interest accrued is approx 30% of the exceeded o/d limit .
Any answers would be greatly appreciated .
