and the bonus is they have re instated my full account. They are sending me out cheque book, debit card/speed bank card and overdraft if i want it also they assured me they will NOT close my account due to the reclaiming of the bank charges. I am totally amazed :)it has seriously restored my faith in banks and people too0 -

After HSBC ignored my first letter, I sent a letter before action. I then received a letter saying their charges were fair and published in their charge book. (I don't ever recall seeing anything that says I would get charged £125 for going over my overdraft limit) They also said if I was to take it to court it would be unlikely I would win. They went on to say that the cost of going to court would be a lot more than what they owed me so they would give me £800. I decided to accept this as I need the money now, although they are stalling as much as they can in paying it back.
I would definitely recommend to anyone thinking of doing this to go ahead. Nothing to lose!!!!0 -

Followed the approach and used letter formats described in web site, had to issue summons - which they duly acknowledged and initially said they would defend - then received letter and full payment within the week. Flash to bang from first letter to full payment + interest and cost was just over one calendar month. Their settlement letter was full of platitudes, about saying they intended to defend claim, but for commercial reasons and as they wouldn't be able to reclaim their legal cost they decided not to defend.
Their hypocracy is breathtaking, and although I'm sure they'll find a way of coming back at us I must say I'm proud to have been involved in this process. They hit me with these charges at a difficult point in my professional life, but I'm now back up on my feet. I'm delighted to have the funds back, but actually quite dissapointed that Halifax didn't go to court by the time they'd surrendered I was well read into the issues and would have enjoyed my day in court.
The aspect I find intolerable is that the banks set themselves up as being beyond the law, almost a parallel government. Well I'm using a tranche of these funds to finance a trip/expedition to Greenland - I jest not!

Amount Claimed: £252 (1 years charges)
I gave them 14 days to reply and i had no reply by 14th day so sent a letter saying that because I had had no reply I was going to pursue them in court for 4 years of bank charges totalling £573. I didnt do the full 6 years because i felt HSBC's charges 4 years ago were (i believe) fair (£20 month, maximum 1 charge and could be any amount over overdraft)
2 days later I received a letter saying they would pay £252.00. I wrote back saying that they were too late and to evaluate my latest letter....

Total time : 4-5 weeks
All this was done through all for free through http://www.bankchargesrefunded.co.uk whos standard letters were excellent, well written, and they also offered free legal advise if it ever went to court or a D.I.Y section to try for yourself.
HSBC never contested the amounts, they sent a letter saying that though they didnt agree with me that the charges would be refunded and I had to sign a form saying that the settlement had been paid and could never be contested in future.
This was back in may and i reccomend anyone to try this.

See my earlier message. Claimed through Moneyclaim online, and although they filed notice to defend, I received an extremely courteous, polite and apologetic letter stating that they have credited the amount to my account today. They include a leaflet re their complaints procedure.
I cannot fault their customer relations! Thanks Martin for your help. :j0 -

At first, they disputed that the charges were unlawful and offered me £20 as a goodwill gesture. After the second letter they still disputed they were unlawful, but gave me the money back anyway 'to appease me'!!

Bank -- Nat west.
Claimed on three accounts over a period of 6 years.
Amount = £6285.61 (+ interest of £696.68.).
Total = £6982.29.
Was offered £1441.00 on 11th august after sending the 1st / 2nd / and a 3rd letter , the 3rd contained a total schedule of ALL charges (but not interest).I refused the "part payment", it also stated that this was a "Full & Final" Payment.
It's not easy,but if you follow, to the letter, ALL the advice on this site You WILL get results.
I have now Claimed through "moneyclaim", And am hopeful !!.
The nat west bank Came up with various methods of "Delaying", by stating that the OFT ruling did not apply to them,And the charges were fair & reasonable, and ,anyway I signed a contract with them.
I sent them a short letter( based on the letters on this site) stating that the charges were unlawful , unreasonable,And according to the OFT (I think), Banks were not supposed to make a Profit ,nor incur a loss from their charges.I asked "how long does it take,and what does it cost you to bounce a cheque,return a direct debit,etc,etc."
Well I wait with bated breath for the final conclusion after using the online court system, I hope Martins right.( I believe he IS ).
I filed a Claim through moneyclaim ,the Natwest acknowledged the service of the claim and now have until 1st sept 2006 to enter a counterclaim etc,etc.0 -

Story
Wrote the 2 standard letters requesting charges back got standard letter back offering me half.
Issued claim on Moneyclaim website, in late March, the bank waited till the last possible minute to go through system.
Received another letter from my local court giving me hearing date of July 06. Received an offer out of the blue from bank that was £950 short of claimed amount. (THESE ARRIVED ON THE SAME DAY!)
Wrote letter back to bank, requesting full amount, 10 days after that received letter offering me full amount, ... nearly 2 weeks later they finally transferred the money into my account, very very close to hearing date.
It took around 5 months! I did it with the help of the consumeractiongroup.
I started thinking about taking action after reading a thread about illegal charges on this site just before Christmas, it was gradually getting longer and longer and more and more fascinating, I'd have a look every week at that thread, as it was like a story, but with real people and real results!
