    Amount they paid: £326 (full claim plus £50 Money Claim Online Court Fee)
    The story: Followed all the instructions at https://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/ to the letter. 1-6-06 wrote to bank. Reply that they think charges are justified. Next response offered me £69 in full settlement. Eventually (5 Sept) they said they were prepared to contest my claim but that it would cost them far more than my claim to defend it and offered full settlement (without admission of liability). I didn't quibble about the interest, it would have come to about £20 which I can live without. Their letter said if I didn't keep my account within my agreed limits they reserved their right to withdraw banking facilities. So I'm going to open an account with Nationwide.

    Got a letter this morning offering a full refund after sending preliminary letter with detailed charges attached 2 weeks ago. Had drafted my letter before court action which I was going to send today but they got back to me just in the nick of time!

    I'm amazed at how easy it was to get them to pay up. I advise anyone who is (naturally) skeptical of this whole thing to just trust me when I say how easy it is to get your money back, the banks don't have a leg to stand on and will pay up.

    Wrote a letter to the bank asking them to refund if not all, then part of the money I'd been charged over the past couple of years for exceeding my overdraft limit. I thought the case of First Direct was particularly unfair to customers as they don't even send a letter stating what charges you are going to be hit with (where's the administration costs?).

    They wrote back saying that although they could take this as far as court and they were confident they would win, but because they were "mindful of the management time and irrecoverable legal costs we may incur in relation to such a claim", they decided to give me the lot back.

    So, I'm pleased. I'll just make sure in future I don't go over my agreed limit!
    I'd say to anyone else wondering about doing this, then just write a letter. What have you got to lose?

  • I sent a 'Martin's Letter' recorded delivery letter to my bank manager. 10 days later I had a very nice from the bank saying althought we admit no liabilty.........................


    Asked for £940.00

    Got £860.00

    The story:Was a long old process but just had a letter back from Halifax saying that the cost of going to court would be more than refunding me my money. Was a long old process but got there after lots of letters and using the Money Claim site. Thanks Martin! £294 is a lot of money to a poor student who has none!
  • Damam about 8 years ago LLoyds TSB did the same to me shame cause I don't use the account anymore, and possibly think it may be closed, if not, could I claim back the unfair charges from 8-10 years ago?
  • Halifax charged me £240 for going £22 over my overdraft (in about 10 small transactions, therefore a charge for each transaction)
    They have agreed to refund £102....still robbing me of £138 but........its better then nothing i spose.

    The story:

    After receiving two replies to the first letter, (the second saying they will investigate within 6 weeks), I sent the second letter saying that 6 weeeks was unacceptable, 5 days later the money credited to my account!!!

    I exceeded my overdraft last month and received three letters, one to say I would have to pay a charge of £28.00 for exceeding my overdraft and then two further letters to say they had honoured a cheque and card payment, which cost me £30.00 per letter. I followed the instructions about ringing first, then writing with no success. Last week I sent the "letter before action". A Review Manager rang on Tuesday and Wednesday of this week to speak to me but I was out, and this morning I received a letter from him to say they would cancel the £28 charge due to be applied to my account on 30th September as a good will gesture and that if they did not hear from me within 6 weeks they would assume I was happy.

    I rang this gentleman today to let him know I was not happy and would proceed to taking action on Monday next week (14 days after writing letter to Halifax). Within a few minutes of putting the phone down, he rang me back to say he had spoken to his manager and was going to reimburse the £60.00 for the letters and the £28 charge, as the time and cost of court proceedings and inconvenience to myself were more than the cost of the charges to my account!

    I want to say a very big thank you to those of you who have posted your success stories, as this gave me the confidence to try getting my charges paid back to me, and thank you Martin Lewis for an informative and useful site.
  • Strange,not one of the success stories has made mention of having their debt default entries removed from the register !!! Has the certainly deserved refund of their money made them forget about this part?
