  • Bank - Bank of Scotland NSPCC card
Amount claimed - Just the £25
Amount paid - £25 but they said that it was a good will gesture rather than paying my claim!
Story - felt a bit mean as it's an NSPCC card, but I doubt that they see a penny of the charges. Have now been charged £12 for late payment (?reduction in charge as result of judgement?) am now trying to get that back.

Would they give you any longer? Send a letter before action allowing 14 days before action is started (they reasonably have 28 days under the CPR).

I have done the letter allowing them 14 days. It was the second letter I had sent them after they had turned down my first request. Its time for war

Well, they've not left you any choice now have they? ;-)
  • Bank: Alliance & Leicester
    Amount Reclaimed: £68
    Amount they paid: £68

This was paid after the first letter and was covered by a 'gesture of goodwill'.

What makes this sweeter however, is that these were charges for two (uncleared! - NOT) cheques that I wrote to cover setting up two ISA's. Now I had the money in my savings account (also with A & L) and transferred it to my current account (to allow for the cheques) the same day, but these two cheques seemed to clear in about 8 hours (and I subsequently got charged for them).

How is it when I pay a cheque from my account then it seems to clear almost immediately, but when I'm waiting for funds to clear for soemthing that I've paid in I have to wait at least 4 working days.

Quite frankly, I think A & L are turning into a right shower of sh**e these days.

Thank you - rant over

    Dear Mrs ITSARICHMANSWORLD

I'm sorry that you've felt the need to write to smile about the charges applied to your account and about the time it's taken to reply to you.

I've reviewed your complaint a refund of the charges applied to your account has been agreed. As such £435.02 has now been issued to you in cheque form as a gesture of goodwill and will be with you shortly. As debit interest does not constitute a charge or fee, this has not been refunded. I hope you find this result to be satisfactory.

At this stage we are required to let you know that smile will regard your complaint as closed if we do not receive a reply within 8 weeks of this response.

If you remain unhappy you may ask for your complaint to be referred to the Financial Ombudsman Service. Full details are on our website, https://www.smile.co.uk / talk to us / complaints.

    Yours sincerely

  • Bank: Smile
    Amount Reclaimed: £795
    Amount they paid:£795
The story: 2 letters, then they paid the money straight into my account without any arguement or notice that they were doing it! What a nice surprise! Result!
    Thank You xxxxxxx
  • Can anyone please give me a tip???

I have wrote to my bank on two occasions now and they refuse to pay out and twice sent me a leaflet which states that i would be charged the amount which i did.

The second time i wrote i clearly stated that it wasn't the charge i was contesting but the amount of the charge, again they sent me the same leaflet

What should i do now? And also should i have asked for my statements to total up the charges so i can tell them the set amount i am re-claiming?
If so how far back statements can i request and anyone know how much they charge for the statements? My bank is Halifax if this helps

I am a student so every penny i gained is gold to me

    Thanks
  • Bank: First Direct (HSBC)
    Amount Reclaimed:£114.26
    Amount they paid: £110
The story: They offered the charges back after the first letter (template from Martin's links), but refused to pay the debit interest - I thought, what the hey - let them keep the four quid!

    Now, Barclays...

Use the templates at https://www.consumeractiongroup.co.uk - its free and they've got all the technical stuff in the letters so you'll have a very good chance of getting a refund after the first letter (like me!) - good luck!
  • Hi,

I have used the pro formas on these sites to reclaim charges totalling £1600. Natwest's solicitors have submitted a 12 page defence today, which is asking me to provide proof of charges (which obviously I have from bank statements) and to provide a defence to everything written in the pro forma letters.

What should I do now? Clealy I am no legal expert. Should I reply at all, or leave it? Do I need to send them photo copies of my bank statements detailing charges?

    Any advice would be fantastic.

NB - I note that this website says I should nothing, but the (court?) letter says I have to sumbit a defence by October 15th?

    Thanks
