Have gone through the procedures of trying to reclaim bank charges from Halifax:
1st step: got past 6 years bank statements
2nd step: sent first letter - NO REPLY
3rd step: sent 2nd letter threatening court action if no refund - LETTER REFUSING TO PAY
4th step:Filed a claim online - NO RESPONSE AFTER 20 DAYS
5th step: Filed a judgement requesting money immidiately - 6 DAYS LATER STILL NOTHING!!!!!!!!!!!
Will i get the money? Has anyone been in this situation? Do not want to file a warrant as it is more than £5000 and i want all of it back. Please if you have been in the situation post a reply back....If not i will keep you guys updated of progress!:0 -

I wrote one letter to MBNA, with the £10 cheque, asking for a full list of all charges against my credit card. I received a reply today denying everything, giving me my cheque back (!) AND giving me £1250 credited against my account! Best letter I ever sent! Tomorrow I will be clearing the remains of my account and I'll be shut of them!0

:T Hello All, please bear with me this is the first time I have done posted on any site.
Bank Charges Reclaimed Barclays Bank
Approx £1200 plus interest plus £120 small claim fees= £1600 approx
I used Consumer Action site for letter templates
1 they offered half at first, I declined
2 filed a small claim paid the £120 as shaking like a leaf at the mere thought of loosing £120!
3 They did not respond within 14 days won by default:p
4 Requested judgement and immediate payment
5 they really got on my wick legal said it would be there on Monday (it was Friday) if I faxed them copies of my figures 'so they could check them or they might have to ask the court to set aside the judgement' Monday came and they said it 'might' be in my account Tuesday or Wednesday. Became cross, told them either pay it by Tuesday or I'd ask Moneyclaim online to issue a warrent, money finally arrived Tuesay 10am. During my conversation with the 'legal dept' they admitted they were very busy with these claims and I had 'slipped through the net' as it was not their policy to allow claims to go by default. Was also told by customer services they might close my account, don't care I have another account in another bank.
I was asked by the legal office if I would agree to 'remove' this court judgement from Barclays credit history, I again refused, welcome to the real world Barclays, now onto the next lot, charges levied whilst this was in progress and my credit cards! tilting at windmills can be fun.:j :j Thanks to sites that helped.0 -
goodie2shoes.......congratulations!!
Our cases seem similar.............i entered judgement on the 20th September and am still waiting.........phoned legal department today......they still have no record of paperwork from court regarding initial court claim and judgement. They have record of letters i have sent ( strange that!!!!)......I said i wanted to know exactly when the money will go into account....because otherwise i am going to issue a warrant which means sending the bailiffs to my local branch. The guy said they are inundated with these cases at the moment and it may show in the next couple of days.....have even faxed through my copies of proof that they owe me the money. Have said i will phone in a couple of days (Fri) and if its not in my account will issue a warrant. Should i follow this through on Friday if they still say its caught up in a backlog? What do you think?0 -
Hi there - stick to the time period stated in your letter for them to respond, they are hoping you will forget and it will all magically go away - if they don't respond within the time period send them another letter saying they have another 14 days to respond or you will commence court proceedings and be prepared to do it. You will have to pay court costs but you can add these to the amount you are claiming back. In most cases they will agree to refund the money...above all stick out for the FULL amount, don't accept a partial refund. The only case so far where I have not been successful in obtaining a refund is with Barclays, the case is about to go to court, but if its like a similar case I read about (posted by icefall 15/7/2006 in reclaiming bank charges SUCCESS stories) they will give me a full refund just before the case is due to be heard in court... I hope, but if not I am quite prepared to argue my case at court. Good Luck.........Dave0
