Ring up Lloyds and see if you can get the account number from them. Or go to your local branch with ID. They maybe able to tell you."He's a maniac, maniac that's for sure,
He will kill your cat and nail him to the door"

You cannot claim statuatory interest until you file a claim with the courts. Do not put this in your first letter!"He's a maniac, maniac that's for sure,
He will kill your cat and nail him to the door"

Martin does suggest though that you add the interest in at the start...
Charge interest on top
If you won via the courts, you would be entitled to add 8% interest (not compounded) on top from the date you were ‘first deprived’ of the money (i.e. the date of each charge). Therefore you may want to ask for the interest as part of the initial claim. It's important to understand that you are not legally entitled to interest unless you win in court, yet all prior letters are a tool of negotiation; think of it a bit like haggling.
You may get lucky and get the interest on top, but even if not, the legal feedback I've had is that it’s one route to pushing the bank to settle quickly so it can offer to pay you without the interest. Of course there is a risk that asking for too much makes them less likely to settle too - sadly this is an art not a science. This isn't an easy concept so I've recorded a quick audio file which may help explain it.
For those who do want to ask for interest, I’ve had the calculator below specially built to work it out for you and included it as an option in the template letters later. However, if you'd prefer to play safe simply ask for the charges without interest in the early stages.

rhino5 wrote:Hi everyone,I have reached a slightly problematic stage in my claim with Yorkshire Bank.
They have sent a letter from Customer Relations in Glasgow but on Yorkshire Bank headed paper.
Apart from telling me that the charges are all my fault and threatening me with breach of contract they have sent a cheque for less than half the claim stating it is full and final settlement and I will be deemed to have accepted if I cash the cheque - I undersand the response I need to make in terms of accepting as partial payment but continuing the claim but should I cash the cheque?.
Also they sent this letter on the same day that they acknowledged my MCOL claim against them (Yorkshire Bank PLC) giving them 28 days.
Do I need to tell the court anything?
They have also acknowledged the claim stating they intend to defend all the claim but in the name of Clydesdale Bank PLC and given a Glasgow address.
Do I respond to their offer to Clydesdale at Glasgow?.
Finally I would like to say a big thankyou to all board users and in particular Rex Mundi and Edinburghlass for giving me the support and confidence to get this far.0 -
As they specifically said that if you cash the cheque you will have accepted their final offer I would hold off meantime in cashing the cheque, tempting though it might be. However I would reply to Glasgow with the phrase "partial payment etc" .
Presumably with the Christmas post letters are crossing and you just need to carry on with your timescale and prepare you court defence.0 -

Sent a letter on 21st November along with £10 cheque for six years statements to my local natwest. This was posted by recorded delivery and the cheque was cleared back into my natwest account on the 24th November. Sent another letter to Alex Lyons in Edinburgh on the 2nd January 2007 giving them until today to provide with the information that was requested or I will report to the Information Commissioner. I provided my telephone number on the letters and the post has just been and still no reply.
Don't know what to do now. I don't know whether to just forget about it.
Can someone please help.0
