this may have been asked before but i am new here ...i have a bank loan and overdraft.. will the bank make me pay this back if i try and reclaim bank charges..thanks for any advise

If the overdraft is linked to the account ur claiming then yes they can ask you to repay everything and close the account. I think the loan comes up as a seperate agreement so they cant(not sure but maybe someone else can clarify)

Hi, I got a letter this morning from Lloyds TSB stating they were putting £425.00 back into our account. I followed your letter templates and they first reply was very negative but I sent your second letter offering to go to a small claims court and the next the letter arrived this morning. It has taken approx 1 month do go through.

I advise anyone to have a go what have you got to loose?

I think the N1 claim form comes as a pdf (if I remember rightly). If you have software that can edit pdfs (normally Adobe Acrobat, but there are free programs out there), then you can download it and type in your details.
Hi rex, thanks for that. I think I've worked out how to get the document with Adobe Reader. However that still leaves me with the question of the "blue print" . Sorry I must have given the impression on my last post that this has something to do with the claim form (my mistake) when actually it is in the instructions on how to fill in the claim form. By the way if I can't manage to work out how to do this all electronically is it just as legitimate to write all the details in by hand? Sorry for being such a dunce but as I said on a previous post I don't want to get tripped up on a technicality.
Thanks for your help and your time.

    Bank: Cooperative Bank
    Amount Reclaimed: £40
    Amount they paid: £40
The story: Transferring money between accounts last April, through online banking, I made a mistake. Within a few minutes I restored the money back into my current account. I was charged £25 plus £10 for that unauthorised overdraft (part of a day). Using the template, I sent my letter off. I received an immediate response saying that I would be contacted. Within 2 weeks the refund was in my account.

You are only entitled to the statutory interest once you've issued a court claim. This interest is nothing to do with reclaiming bank charges. It is the statutory interest you can charge on a debt when you make a county court claim.

Thanks Rex, I'm off to total my charges (I believe to be over £2000) and send the claim in!! Here's hoping
  • hello people
I've read all the past posts with interst and would like to say thank you to all those that have posted,I notice that alot of people sent their letters recorded delivery or registered post which ofcouse is fine, but if you live or work near your bank you can always hand it in over the counter and get a receipt right there and then and ofcouse it saves you postage.;)

    all the best

    Barclaycard

Claiming £427.68 inc interest + £50 court Fees
This is the first one i did back on the 30th August, they offered me £180 good will gesture which they credited to my account, even though i rejected it. went through MCOL and took them to court on the 27th September and they filed a defence, so got transfered to local court in Leeds. Im STILL waiting for a court date as the Leeds court say they all bank charges cases are being passed to the "mercantile" court where they will all be heard together by one Judge to possibly set a presedence and they are awaiting High Court direction on when and how to do this. I was starting to lose heart on this one until today.........

    Halifax

    Claimed £1341.00 + £324.54 Interest + £120 Court Fee
    Paid The lot!!!!

Offered £596 as gesture of good will last month which i rejected, so took them to court through MCOL just before Christmas, they acknowledged the claim so had another 2 weeks to file a defence but checked my account and they have paid in the Full £1785.54. Started this way back on the 30th August too, but just kept at it and at last has paid off.

    Capital One

    Claimed £700
Offered £296 , i had accepted this just before christmas as i seemed to be getting nowhere and could do with the cash

Did all this through MSE/CAG websites and now couldnt be easier with martins new pages with all the templates on it.

Go for it folks, its your dosh, and you will get it back in the end.

I got some of my statements back from Barclaycard but prior to may 04 they will have to dig the rest out of archive and send under seperate cover. Please let me know how you get on with them as then I'll know what to expect. Good luck and thanks for this post.
