    There you have the problem...if you read the various threads you will see what was signed up for can vary and doesn't tally against anything else they print or tell you if you call them.

    Only you will know the exact details of what you signed up for, there may be others that can help you but I would urge you to sort this out quickly so that any time frames don't pass which will enable them to cancel your current and all future cheques for the length of the contract.

    I wouldn't do those things. I'd make sure I understand the legal t&c I signed up to and can prove. Then I'd resend the correct bill according to those t&c or if too late and I did comply with the legal t&c - which seems unlikely in this case - I would write a clear and firm LBA then sue. Don't fanny around with E2Save now. If it's too late to send the correct bill at the legal time and your claims were all denied before that time expired I would so the same thing on the basis that they have broken the contract. this IS a price-match deal so check the t&c - the real ones, not the simple ones and other rubbish they send you and tell you. However, I very much doubt the OP actually read that alone copied them at the time - so that will be an serious problem now if I am correct in that assumption. I will say it's amost definitely not the fourth bill you should have sent under the legal t&c, although had you sent it at the (narrow) right time they might have accepted it under the t&c they are following (which aren't the legal ones). READ THE THREADS.

    soolin is giving excellent advice. Apart from the usual problems they are creating though I am not sure how the "upgrade" may complicate things. It is always a little unwise to do any upgrade with them unless you fully understand the t&c and have it all confrimed clearly in writing.

    I have had it confirmed over the phone that they class upgrades as a completely new contracts and have noted time, date and person I spoke to for that one. I think I am going to stick with my original terms as at least I know legally I am in the right - see how things go from there and then go down the legal route.

    I have also found a copy of my original terms which is good and helps me.

    Then you really ARE asking for trouble! Ignore whatever they say over the phone - and most of what they say in their emails. As for the t&c, they are almost certainloy entirely different, whatever the ones were on your original deal. There's only one way to do this - as advised on here and not by them! but it's your money!

    the problem is you cant win - If I send in the one im contracted to send in then they can reject it for being early. If I go under the new terms and send next months then I no longer have future backup encase of any problems. I appreciate everyone says to stick to the new terms but legally Im not covered under those

    Why is that? If they're the ones you signed up to you definitely are. Unfortunately you don't seem to know what you are signed up to. However, an upgrade is a whole new contract so it's highly improbable that the t&c are the same - especially since this company are now doing their best to change things constantly and deliberately and blatantly misleading people.

    sorry I must have confused you - its been one of those days! The terms I signed up to were the ones where you literally send on the 6th month etc and it was very straightforward. I was confused at first with all the talk about 120 days etc

    Hi everyone,

    I posted earlier today and found this thread thnks to mobile junkie. I received the dreaded letter today sayign i had missed the timeframe of the claim even though i thought i had sent the right bill at the right time.

    I've read through quite a bit of the thread altho not the full 42 pages! I've read that the bill number oten is irrelevant

    Well i based sending it on the bill number i got my first bill in August and sent my November bill to them which was dated the 15th of November (i think) and they received it early December.

    My T+C's say
    Instalment 1: - Send us the claim form and original monthly bill showing your name, address, mobile number and tariff you are connected on, that arrives showing you have been connected for 4 months. i.e. if you were connected on the 1st of January, you need to send in the bill that is dated around the 1st of May. This is 120 days (4 months) after connection

    As others have said it says 4 months and 120 days does this matter. I fear i've made the mistake to be honest.

    This has happened a few times lately - thanks to their completely misleading inforamtion (which on one of mine actually told me to send in the THIRD bill even though it will actually need to be my FIFTH!). Be warned - ignore most of their instructions and thoroughly read, understand and COPY the FULL legal t&c AT THE TIME. Wish I had a £1 for every time I've written THAt on here!

    Right; take the connection date, add four calendar months (step one). THEIR claim window starts AROUND that date and lasts of ABOUT 30 (these DO vary by a day or two because it suits THEM). You need to GET THE BILL TO THEM withing THAT timeframe to meet THEIR t&c (NOT the legal ones). THAT bill MUST be no more than 28 days old when it arrives. Usually means you have a choice of bills but often a VERY narrow time it must arrive in. HOWEVER....

    1) THEY CANNOT DENY ALL FUTURE CLAIMS (OR the current one!) JUST because you sent it in too SOON.

    2) The LEGAL t&c (which they are basically ignoring) allow you 30 days from the date of the bill WHICH IS DATED 120 DAYS AFTER CONNECTION - REGARDLESS of the absolute CRAP they spout about their "claim window". SO:-

    3) Work out YOUR legal claim window and if they give you ANY !!!!!!!! about being outside THEIR "window" send a LBA and then sue.

    One more thing for all those who have at last thought they understand what they're doing now. THE T&C HAVE CHANGED AGAIN - I wonder how many people noticed THAT?
