why do you say about meeting their terms NOT the legal ones? do you mean the current ones as the rest of the post relates to the legal terms0

Same reason I've been saying it for the last FOUR MONTHS - when someone else pointed out (but it was unnoticed) that they are applying different rules to the written ones people signed up to (AND, in fact, have quietly written new ones since in an amateur attempt to cover themselves). MOST people don't even seem to know what the legal ones are - or at least get them completely wrong, encouraged by losts of both dis and conflicting information given out by cpw. In fact, a large number never even SAW the legal t&c or knew where to look - that alone copied and studied them BEFORE purchase (or even after in a lot of cases!).
To prove my point I refer you to a thread I started way back in SEPTEMBER and which I have posted on here amny times (anyone reading things thoroughly would have found it long ago). Post number 5 outlines the answer to your question:-

just had a read and its all crystal. You mentioned that you never send yoursspecial delivery - how do you handle this then. Just curious as Im contemplating special as the last 2 recorded attempts "havent arrived"0

Never mind them telling you that - did Royal Mail? I'm not the only person who's been told that (the last time I bothered to attempt to talk to them was about 3 months ago - don't bother now) they didn't arrive only to be told they had once they'd gone on to ask me for the tracking number so THEY could look it up on Royal Mail. Didn't stop them asking me to resend one of them umpteen times via email though! Even after my fourth copy they asked for a fifth until I drew the line for both that and all other contracts with them. Now they get treated like the more disreputable dealers if they don;t behave (LBA and then sue). They will keep playing games with you and trying it on forever once they've chosen you particular contract to have fun with. I prefer to call in the referee and get them to pay them too if needbe (i.e. the courts).
If as I assume you ARE on the price-match t&c and the ones which "didn't arrive" were according to RM you already have a serious problem. You can't use copies (except for the bit lower down on this post!). FURTHER, fail one claim and you fail the rest (this IS pretty BASIC!).
I have sent numerous claims in on ordinary post, in fact. Still do with a couple. BUT I have a back-up plan and only do it on the right t&c. Quentin quoted their website yesterday; if you're with cpw O2 they say you CAN now send copies. If that's you, PRINT IT OFF AND KEEP IT before they change it again. I have one like that coming up in 3 months time and am expecting "games". Of course, months ago I printed the relevant parts off so can prove they moved the goalposts recently and that MY contract is NOT bound by their change (won't tell you what it is!).
Anyway, if on cpw O2 AND YOU'VE PPRINTED THAT OFF from their website, send recorded and if RM doesn't track send again SD. I have many contracts and lots for a few other people and not had a problem with RD (apart from cpw O2 terminations!). I weigh up the risks and consequences and decide, thinking about what I might do should I have a problem. I do have a couple of things in mind, but I don't always tell people everything!0 -
yep it is cpw o2 and its only online as ive never had a paper bill in 2 years. Thanks so much for your advice will send it special delivery tomorrow - I did read a report online about huge problems royal mail are having with them and at least you get consequential loss with SD....mind you theyre pretty much just as useless LMAO0

That's what I thought of also saying; I think I'd prefer to take my chances with this shower of idiots and three shell merchants than good old Royal Mail when it comes to extracting rightful payments! I have dealt with both a just a few times and Royal Mail comes close to British Gas for its total and utter incomptence and disregard for its customers!0

Right; take the connection date, add four calendar months (step one). THEIR claim window starts AROUND that date and lasts of ABOUT 30 (these DO vary by a day or two because it suits THEM). 2) The LEGAL t&c (which they are basically ignoring) allow you 30 days from the date of the bill WHICH IS DATED 120 DAYS AFTER CONNECTION - REGARDLESS of the absolute CRAP they spout about their "claim window". SO:-
3) Work out YOUR legal claim window and if they give you ANY !!!!!!!! about being outside THEIR "window" send a LBA and then sue.
One more thing for all those who have at last thought they understand what they're doing now. THE T&C HAVE CHANGED AGAIN - I wonder how many people noticed THAT?
Well i was connected on the 27th of July so 4 months onward is 27th November. Received my first bill on 6 August, sent the 4th bill to them dated 6 November and it delivered and signed for on the 4th of December. My T+c's state its gotta be there within 1 month.
I'm goign to write to them to explain exactly how it was outside the timeframe? Should i send recorded or special?
Thanks mobilejunkie, i realise i have been a little naive when i thought i wasn't at all. With CW and The Link it was just a case of marking a bill out to send and sending, OneStop are obviously trying to masquerade as a credible business when they are crooks. Partly my fault too then for being naive.0 -
I suspect they will say the bill was received 29 days after it's date and some of their rubbish staes 28. You fell foul of the legal t&c (which they don't use) but did at least get it there within the dates they actually use. I think you're main sticking point will be the 28 days they allow against the the 30 in the detailed t&c at the time.
I would add that actually Onestopphoneshop ALWAYS operated this way (t&c I mean) and the new ones were ignored since they don't! Understanding the history and the changes makes it possible to see what's going on with them. However, the basic core is that they are now deliberately misleading people, ignoring people and trying mould whatever they decide to do at any given time around the legal t&c - which is a complete nonsense!0 -
I checked into it and you need to send the bill that's around 120 days after you took out the contract (that was the 5th bill for me). Also, the bill must be less than 28 days old when the receive it.
For me, this meant I couldn't claim at the start of my claim period as the 4th bill would have been over 28 days old by the time they processed my claim. I had to wait a week or so for my 5th bill and then send it off.
Hopefully, my claim will proceed OK.0 -
That's if you follow their t&c and not the ones you signed up to - in which case the 4th bill would be void however the dates fell (assuming you get a bill soon after connection). No need to check either - the t&c have been around for at least more than a year now - albeit not with them (they simply copied from a competitor). The time to "check" is BEFORE you sign up to anything involving a cashback. And "check" is insufficient as well; anyone falling foul of THOSE t&c may WELL be able to claim for the FULL cashback if they follow the LEGAL ones - provided, of course, they've followed ALL the other groundrules.0
