    Oh my word. These people really don't like to admit they are wrong. Got another email from them.

    Just a word of warning to anyone pursing legal action.

    You really, really have to be persistent. They may say they're not in the wrong, and you were. And that they are only giving you the claims as a gesture of goodwill.

    And no matter how clearly you explain it all to them, it's like they don't read your explanation properly, or just ignore it altogether.

    If their offer is unacceptable, then don't pay the cheques in.

    You can then continue with your claim, and explain to the judge (if necessary) that they would only pay you what you were owed in return for a change in your contract to your detriment.

    The case will then be decided on your original claim, and a judgement issued accordingly.

    Whenever a cashback retailer breaches the contract by not paying despite a correct claim, then they make a relevant breach of the contract which does allow you to ask for the whole amount outstanding under the original contract to be paid, and this would have stopped all this if your claim had been for the whole amount, rather than the late payments.

    In case anyone is interested, and to spread the word: I am in the process of filling out the moneyclaim form. The first cashback (4 months) was paid without problem. The 6 month cashback was refused as too early. A repeat claim was not acknowledged. No response to the LBA. I gave until 31.12.07 for a reply and (more generous than e2s) allowed a week for holiday and postal delay. I'm going for breach of contract and the whole outstanding cashback. I want to say thank you to mobilejunkie for his (or her) helpful comments through this thread.

    Good luck. I got as close as a whisker then a cheque arrived. Likely to have a repeat performance this month and expecting trouble on another one in about 2-3 months. They are getting worse by the day! Let us know what happens (with so many now it's hard to remember/keep up!).
  • Hi, the problem i have had a problem with e2save aswell! Aparently due to not sending during the correct timeframe i have lost ALL my cashback. This seems highly unfair... i can understand losing 1 months..... but all is a bit too much!

    It is in the terms and conditions that you agreed to upon signing up. MJ has warned everyone.

    You may not have lost out. If you post:

    - The date you started/connected
    - Your first cashback date
    - The date of the bill you sent to them
    - What time that bill got there by

    You may actually be ok, and if you are, can sue them for breach of contract.

    can I ask how long it normally takes for an acknowledgment of your claim being received? E2Save were great with the cashback on my old contract but as this is a new one and it was a different address Im just a little cautious

    You're well out of touch. NO acknowledgements. Either a cheque, a letter or nothing! Read all the relevant threads - there are plenty of them now!

    Hi everyone,

    I sent way for my 1st cashback claim from OneStop last month, it had been over 30 days on Monday there sending them an e-mail, they replied back with basically their help page on cashback claims - even though you read that before you e-mail them so it wasn't much help.

    However, received a letter today saying they had received my claim but cannot pay out as it was outside the valid timeframe. Also, as part of the T+C's all subsequent claims cannot be accepted.

    This is my 4th cashback phone (admittedly, the others are from CW and Phones4u) and i know many of these companies are dodgy but OneStop got a much better review on these forums and owned by CW so i went ahead. I'm not an idiot lol so i did read the Terms and Conditions thoroughly and knew if one claim was rejected the rest would also be (extremely unfair) but i knew that this would happen.

    However, i am sure i sent in my claim at the right time. The terms and conditions they sent me said i should send my bill for the 4th month and i received my first bill in August and so sent the bill i received in November, within 5 days of receiving it to OneStop.

    What should i do? Sorry i know there many posts like these but i have had many cashback phones for you and read the T+C's thoroughly although i will be embarrassed if i have made a mistake!

    Any help will be greatly appreciated.

    it has changed then!! Apologies I knew 42 pages would take a long time to read! EMailed and suprise suprise they havent received it yet!
