I'm in almost the exact same position, connected on 28th August, first bill on 6th Sept and subsequent on the 6th of each month.
When I ordered the phone I was clearly told to send in the 4th, 6th, 8th, 10th and 12th bills (I was cunning a got her to put it in writing in an email as I'd seen the start of problems on this site), when I log into My Account it tells me to post my bill 'in Dec' but when I read the Price Match T&C it clearly states that I need proof that I am still connected after 120 days - which is 28th Dec, and therefore surely 6th Jan bill? Though I have seem some people say we can send in the 6th Dec bill after the 28th - but surely that doesn't prove I'm still connnected on 28th Dec
I'm regreting getting this phone now - I've had 5 cashback contracts with them before with no problems (they even paid one I sent late) but they're playing silly billys now - grrrr!
I emailed them yesterday hoping to get something in writing - cross fingers.
Help! I can't lose £420 and I've got 5 claims to go yet. What do I do?0 -

You already have something from them in writing - why not just stick by that?0 -

Because it is 'just' an email and it contradicts the printed Terms and Conditions I got with the phone - I'm not sure which is more legally binding.
I have been reading this thread for hours! I'm pretty sure I understand the 120 days terms and that this means I should send in the 6th Jan bill (as this covers the vital 120th day and is within 28 days) but that original email from the sales assistant states send my 4th (6th Dec) and My Account on the e2save site says "Send month 4 claim in Dec 2007", which I obviously can't do if it's the 6th Jan bill.
I'm as sure as I can be that I understand each set of terms but they contradict. So - the big question for me is which do I follow that will
1) Give me the best chance of them paying out
2) Give me the best legal redress if they don't
I really appreciate any help!0 -
The t&c you signed up to at the time are binding. I'm sure that's what Quentin was referring to.0

Thanks, that's what I'll stick to then. Wish me luck!!0

Good luck. Though at the end of the day luck shouldn't be a factor!0
