  • They are going by the start date for the 30 days rather than the bill date. You have to watch that too - although they're not following the proper t&c that way. If the 28th is ok and the first attempt is successful I think a cheque may well have been raised within 2 weeks of receipt - JUST giving you time to re-send (subject to what I just said about their dates window as opposed to the one in the t&c). I think you have a good chance with the one they already have, but unfortunately you need to try to cover yourself if it's not certain given the way they now approach things.

    My contract says send in the bill showing you have been connected for 120 days. Since the first bill (Vodafone) is dated the day of the beginning of the contract (2 Dec 2007) then I think I should send in the 5th bill which will presumably be dated 2 April 2008 or thereabouts. Does this sound right to you, Mobilejunkie? Or am I missing something?
  • That's the correct bill to send, though you may find they allow slightly less time each claim to get it there despite the t&c. Only a few days short though so send it straight away and you should be ok if you do everything else right.
  • And the complaints go on... and not just the standard ones now! Believe it or not, there are still a lot of people under the illusion that they are as before!!

    I'm afraid you can't win this on in my view. I send standard post but if Im not sure (and can prove) that it's been received I resend withing the window - you didn't. Your only chance is to use the instructions to resend - provided you have it in writing and were prompt in so doing.

    With all the "errors" they now make you can't afford to make any of your own!

    but i actually have proof that iv sent it and theyv recieved it, theres not much more i can do!

    does anyone have an email address apart from the one on their sites, iv tried emailing everyone but no responses. i may just have to start small claims thing.
  • My mistake; then provided they received the correct documentation within the legal timeframe send a LBA and then sue. Emails are hit and miss and they've apparently told you they never received it even when they did in any case.

  • Luckily i checked this thread before sending my claim. Want advise on which bill to send.

    Connected 15 aug - 12 months contract

    Bill 1 - 30 Aug
    Bill 2 - 30 sept
    Bill 3 30 oct
    bill 4 30 Nov

    was just about send bill 4 but after reading all the posts im confused. Is it bill 4(30 Nov) or the one i receive in december?

    Any advise appreciated? going to ring them anyway but just want a second opinion as im sure when i rang a couple of months ago they said the 30 nov one but think he just calculated it and did not read off the screen.

    I need to know what the transaction number is.
    I thought it was the unique order number when you signed up. Am I missing somthing obvious ?
    My first claim will be the bill in early Jan.

    Your transaction number appears at the top of the printed invoice that came delivered with the phone.

    I'm currently taking legal action. Sent them an LBA on the 29th November, and still not heard a single peep out of them. So lost hope and paid the £25 to legally claim against them.
