    Good result. They have also now set a precedent on your contract for when to send the remaining claims!

    I've also just looked at another post in this forum which gives a link to companies house which appears to show that several mobile co's are in liquidation (inc e2save and OSPS) can anybody confirm!!!

    Hmmm would be news to me. And yes I saw the post and checked up e2Save and OSPS, both showing as liquidated.

    It could be a case where they were separate companies and have been brought under the same roof by Carphone Warehouse. Anyone else got any input on this?

  • It's all to do with the mess they've created since about August. I have the same situation precisely on one of my contracts. My LBA goes out on Monday. They are attempting to change the rules more than half-way through your contract. Those who refuse have generally been paid; recently someone posted an email statitng they will honour the original t&c but clearly they change their tune every day.

    Two choices; stick to your guns and send the correct months as per your original, then a LBA and then sue if they don't pay (my course of action) or comply and send claims a month later. That's unacceptable to me though they've been very carefuly not to deny my correct claims. I have argued and warned them several times; now it's a LBA then the courts. I will win and they will lose if they chose to test me.

    I was wondering if anyone could see if there is anything tricks I’ve missed out on the price-match cashback offer.

    The connection date of my contract was 5th Aug 2007. £35/mth o2 network
    My bill dates are the 12th of every month.

    According to my calculations I should start to process my cashback on the following dates..

    3rd Dec/ 1st Feb/ 1st Apr/ 31st May/30th Jul

    I have the price-match T&C which can be found on the below link.

    Slightly worried about other people mentioning E2save has changed their T&C. I’m not sure where but when they send the standard T&C, they said if I was on a pricematch offer then I would get this by email. When some posters have mentioned the change, are referring to a change within their T&C price-match offer?

    From these T&C it sounds like I need to prove I have been connecting for 4 months. Therefore am I right in thinking that it’s irrelevant to show them my November bill as it doesn’t show I have paid for the December part?

    If I send my 20th November bill, I can only claim it from the 3rd dec – 19th Dec.
    But if I wait for the December bill (very risky as it’s Xmas and post are generally delayed) I can only claim this from 20th Dec – 2nd Jan. The question is, what one is correct?

    Last couple of questions, if I take out itemise billing will this affect my cashback, E2save might claim that’s changing the contract? And they have attached some cashback vouchers in my email but can print these out or do I have to use the ones they sent in the welcome back?

    1) Whilst it DOES you you have paid for the period it doesn;t show you've "been connected" for it.

    2) Which bill is a dilemna. You pays your money (in your situation) and takes your chance. As long as they stick with the way they appear to be playting the game the November bill sent on those dates will be ok. Trouble is they now change things almost daily, so whatever they are doing whne you post it could change by the time it arrives. Really hard to advise. December bill should comply with the legal t&c and the November one might get rejected; however, the way they approach things they might just as easily do that the other way round. I'd go for the November bill at the first claimable date and follow it up just before the December bill arrives to see if they've raised the cheque or not.

    3) Itemised blling is irrelevant either way.

    4) If the forms are identical use the ones which came with the phone. if not, the ones in the email. Either way they are the forms with 6 claims numbered.

    Thanks for your reply, tell you what, since started reading other people’s problems and your Dummies guide to cashback, it certainly has made me concentrate that extra bit. Right from your comments posted this morning..

    Point 1) That is very true, it doesn’t show that I’ve been connected. Which suggests that December bill is more relevant.

    2) I’m confused by “they appear to be playing the game.” So far I have read other E2save customers saying when they make a claim it’s too early. Not sure if this is their own fault or E2save’s but I’ve not heard someone saying it got rejected for being too late. And if you send them the wrong bill, doesn’t it invalids all your future cashbacks?

    3) Thanks, I’ll get that removed ASAP.

    4) I’ll double check it but I thought the only difference was the hardness of the paper and the colour lol.

    5) Oh yes forgot to ask, am I right in thinking the last claim is basically my bill if I only want to have the contract for 12 months?

    After all that I’m still 50/50 what is right and what is wrong. All I know is I’ve got until 2nd of Jan to make up my mind about the cashback. Speaking to their cashback team last week, they suggested that I can send either but as you mentioned earlier in this thread, what they say and what is in the legal T&C is different.

    For a long time I've been expecting loads of people to be rejected for being "too late"; this has only happened once to my knowledge on here - which puzzles me. On the other hand I wasn't expecting the avalanche of people actually claiming too early - which, in general, was their own fault, in fact. However, telling such early birds they can't claim the rest is rubbish - and those who've held them to account have been rewarded with "goodwill" acceptance. In fact, by any t&c relating to these deals future cashbacks only bcome void when someone claims outside the claim window (whichever version you use!).

    I didn't mean you have to remove itemised billing; you pay extra for it but it has nop bearing on your claim either way. I don't understand your last question. If you go beyond 12 months you won't get any extra cashbacks, but if you end the contract at that time you can still claim your last one. I reckon they ought to pay me for all the time I spend sorting out their mess!

    Re: to my last question. If I’m using the December bill to claim month 4/Feb(m6)/Apr(m8)/Jun(m10) does that mean I need to use Jul for month 12 if I want to disconnect in my phone in Aug( so it’s a full year’s contract rather than a year and a bit)? Or will I still get an August bill?

    Not much competition there! They used to make a half-hearted attempt on here but now have withdrawn into their bunker after the bombardment - that was BEFORE the current mess. Although they do monitor these threads (if I were completely cynical I'd say that was so they could find ways of muddying the waters even further).

    You should receive a 13th and final bill and can use that to claim. Of course, if you're on cpw O2 you'll have trouble temrinating anyway! But that's another story...
