  • You'll have to go the legal route. You have got it wrong I'm afraid - but if you get the rest right the legal route should be quite straightforward. Meanwhile, send in the claim on the CORRECT dates separately to a Letter Before Action.


    The thing is when I took the deal out for my sister, it had no mention of the 120 day stuff. I'm sure it didn't. I copied and pasted what it said on the site and even though, yes it said the T&c was different it didn't have a link below like it said it would . .

    Yes, it's a price match deal.

    They say we should've sent in after 120 days not 4 bills. I was talking about my account (I myself don't have this deal) and in general asked the question on behalf of my sister . .
  • You need to 1) copy the full t&c from the website. You obviously didn't find them last time. Find a 12 month free deal, click on "12 months free". 2) You can point out that the information provided was (at best) confusing and (at worse and most likely) misleading to the extent that you were prompted to send in a bill too early. 3) The actual t&c say you lose all claims if you fail to make one. You haven't - you still can in the timeframe for the first claim.
  • When I originally took this offer out it didn't have all this stuff beneath it. I'm sure of this - otherwise I would've save it along with the first bit! I because I have had good experaince with them in the past, thought nothing of it and naturally just went ahead with it, as I thought it'd be the same as before. D'OH!

    I was not sent a special terms cashback leaflet that they are displaying on these new offers either . .

    Also, even though the guy told me different, there is no mention in the T&C that I just read on their site, that early claims result in no claims at all . . or did I miss it 'cos I can't find it?!

  • The "stuff" was always there - you just didn't find it. I have been warning people for a couple of months now about their "past" experiences with this company. When you write the LBA you shouldn't put in things which are incorrect i.e. that the t&c weren't there when you bought it. You should concentrate on the incorrect information which was also given to you - AND until a week ago would have been showing in your "account" section where the dates actually TOLD people to send claims in a month early. There was a link in the confirmation email for the vouchers I believe.

    I'll have to recheck my sisters confirmation email when she comes home.

    However, the cheque back offer cashback voucher leaflet they sent me (by post) is not the same as online and does not require the same info as the one online . .

    Just phoned 'em again and they say that the t&c clearly states that early cashback claims void the whole cashback deal. I STILL CAN'T SEE IT! Where it says that! Grrrrrrrrrrrrrr . . Yes, I see a £10 charge, yes I see it's void if you send it in LATE but not anything for early . . .

    Also, please help- If I got the Phone on JUNE the 5th when do I send in my first claim. I thought it would've been in October (12th - that's when the bills come) but the e2save site is saying November?

    When you are involved in a dispute of this nature, ringing for answers is just a waste of effort. They can deny giving you the answer etc.

    You need to get answers in writing (on paper, not e-mails).

    And to try and get these from them you need to write in to them.

    Keep copies of the correspondence as they may be needed should this end up in you having a court hearing to resolve the issue.
