I have been away hence not replying sooner.
The problem i had is that i didn't receive the bill until after the deadline, hence their reason for not paying out, despite me ringing them numerous times to request the bill.

Just thought I 'd let you all know that I have received three letters now- in relation to mine, my wife's and my mums claim to say that a hearing has been allocated for all of them. Despite me asking for my wife's one to be moved to the court nearest us it has not been changed.
As such I now have to pay a hearing fee of £50 for each one and my concern is that all three hearings take place after 30 days since the first cashback at month 6 is due.
As such should I send off the bills to e2save during the 30 day window which will mean my claim amount is wrong or should I not make a claim and go for the hearing and if I lose then I find I have missed the first cashback?
For my wife's hearing which is set for the end of October the judge has suggested the mediation service. Has anyone used thisd with e2 save and if so was it worth it.
As my hearing isn't due till December it would be around the time of the second claim.
Given the lengthy timescales involved I am worried and do not want to jeopardise any money and am therefore worried about whether I should continue or should I just bail at this stage?Mark Hughes' blue and white army0 -
The £50 fees you have been asked to pay are all refundable to you by the court if you cancel the hearing for any reason (by giving them at least 7 days written notice).
So no money is in jeopardy by you paying the fee now as requested.
You should contact the court regarding your wife's hearing as it is a general rule that in cases like this the hearing is at the Claimant's local court - ask them why they won't do this.
You should keep sending in claims in line with your contract until the case is settled. This won't affect your claim - any payment you receive will just be taken into account when the case is settled, and an order issued to them to pay the balance owing from your original claim (assuming you win!)
The mediation service is usually of use only in negotiating the amount of a claim (downwards for the claimant!), and may not be relevant for your claim which is for a fixed amount.

Wow, just re-visiting this thread. I was (I think) the first to sue about a year ago. Can't believe it's still going on.
I didn't have to go to court. They paid up. I actually continued doing my cashbacks until it was resolved. In the end they ended up paying me about £150 extra.
What I learnt from my action:
The phone staff are useless, and were sometimes quite rude. Contradicting themselves, admitting to something, then when they realise my point, denying it.
1) They may try to shrug the LBA off. If you've got a good case, just ignore them.
2) When you claim, claim for everything you are due. The cashbacks, legal fee's, phone costs, transport costs to get to the court, loss of earning if you lose a days work at court etc... Otherwise you're putting a lot of additional expense to get something you rightfully should have got anyway.
3) Stick it out. They sometimes try scare tactics. As my court date approached, they eventually sent me a cheque covering all the cashbacks and the whole court action was cancelled.
Ironically my girlfriend never had a problem. I was so strict though (as I found her the deal, I felt guilty) at making her send the bills at a set date. Was more hassle than it was worth in the end.
She took out the £25pm Vodafone deal (through Vodfone), 3 months half price, with £130 cashback through quidco recently. It's not free, but it's nice not having to worry and stress!

There is no problem in cashing cheques so long as they haven't been sent with any strings like "this payment is in full and final settlement of court case no:xxxxxx"
In fact, when they do settle, the settlement cheque comes special delivery from their legal dept., complete with a proforma receipt to send back to them, in which they get you to sign that it is in full settlement of the claim.0 -

Signed up to an 12 month contract with e2save on the 14th March 2008. The deal was the Nokia 6300 black with 12 months free via redemption, (well 0.01p a month). So far so good, got the auto cashback sent on time with no problems.
Kept onto all the bills so far, but havent got the original claim sheet with me.
Logging on to the cashbackclaim website I'm told I have to submit bills for month 6, 8, 10, 12. Does anyone know if these are the right bills? ...I know e2save have been fiddling around with this.
Also, the month 6 claim has to be sent between 14th September and 12 October. Would that be the bill dated 14th August?0 -

Without knowing your t's&c's it is likely to be the bill dated 14th sept as they are likely to say the bill must be no more than 28days old when they get it.

I signed up to a £0.99p/month deal in March. After non payment of the automatic cash back I issued a LBA, which was ignored. I followed the MCOL route and received the allocation questionnaire. Despite ticking no to small claims mediation question, I have received back from the court Notice Of Allocation form on which the Judge considers the case suitable for mediation and both parties are ordered to contact the Court Mediator within 7 days, which obviously I must do. Further down the form, it seems I can refuse mediation by writing to the court within 14 days. Can I reasonably refuse mediation or am I likely to just put the Judge's back up and create further problems?
Presumably everything I have read on this forum, about e2save’s tactics cannot be used in evidence and are just hearsay.
Since starting proceedings I have received the auto cash back, which I have cashed and also a further cheque, in final settlement of the MCOL fees, which I have not cashed.
Any advice would be gratefully received.0 -
