    exactamundo- just think of the 4 consequential loss savings i may not need to purchase as a result of their non-payment, and my first claimable cashback is not until september, so to get the full amount now would be a major boon, and a stress free event for the rest of the contract

    They set the rules and the tone; all the people they aim their dishonesty towards are doing is playing by the same rules they establish (without the dishonesty!), so no-one can really criticise them for so doing!

    I do understand going for the jugular, but for me I like to give a first chance, a LBA asking for the missing payment only or THEN I will sue for ALL future payments due to the fundamental breach of contract (in the same LBA). Others rightly see it different as we are allowed no slack.

    Strangely enough e2save have been by far the best at paying cashbacks for me. I took out a £45 per month deal - 12 months free (800 mins etc.) for my son and all has gone according to plan with the last claim received by them just on Wednesday. I was a bit nervous as it was just after the CNM fiasco and thought the best option would be to take two separate deals of 400 mins etc. to reduce the risk. So if I get the last one it has been a huge success, hence continuing with 400 mins/texts for £5 per month for the next 24 months - they deserve this. ;)

    Just to update in case anyone's interested, they've said that they didn't receive the Claim form so they've had Mason Hayes get on the case and file an Application on Notice to have the default judgment struck out pursuant to CPR 13... Interestingly though they say they're filing a draft defence in support of this, so surely it can't just be their standard bare denial? (Otherwise the judge would be unlikely grant the order to set aside the judgment?)

    Letter from the Group Legal Department offering me £206 (£171 auto-cashback + £35 court fee). They also seem to be claiming they "issued" a "direct credit" of £171 on 21st May - complete tosh as far as I am concerned. I half expect them to file a full defence claiming £171 was already paid (since they're claiming it was "issued" well before I brought the claim) and disputing they owe me the following £249.

    I bet Mason Hayes love the business, though.

    I'm doing nothing more until I see how the court responds to their application... and nonsense they enter as defence.

    The court will probably allow their application, and let the case continue. Because the claim forms are just sent in ordinary post, most courts routinely allow applications when judgement has been by default.

    They will be given time to submit their defence, and this will be sent to you by the court, together with further instructions on how to proceed.

    It would do no harm to your case to write a reply to their offer, simply saying you cannot accept any offer except full settlement of your claim. Then the ball is back in their court. Expect more correspondence from them independent of their solicitor dealing with the court.

    (Refuse to discuss the matter with them should they ring you - ask them to write to you)

    Yeah. It might take the court some time to read the application though (last case I was involved with had a lag of about 2 weeks). I actually spoke to them the other day to get clarification on some of their wording before I write a reply.

    The guy i spoke to and 6 guys afterwards promised me my penultimate bill + my final bill would show my E2save tariff...lo+behild my penultimate bill came showing the tariff i wasnt supposed to be on till next week....BUT..they promise its now been changed back and my final bill will be ok...although my 30 day termination notice is now invalid as i didnt cancel but changed(they say) so i have yo pay another £40 on my last bill to continue, then change my tariff when that expires...As it happens they only charged me £10 for Junes bill instead of £40...so if my last bill does arrive intact, and E2save pay my cash back, i will be no worse of..................do i beieve it.....do i hell....but i'll tell you in 10 days time......

    I have taken E2Save / Carphone warehouse to the small claims court via MoneyClaimOnline for £400 that they owe me. Despite a protracted email discussion with Emma Holloway (she wasn't able to make an offer I was happy with) they did not enter a defence in time so I have applied for a judgement by default.

    Now a cheque for £24 has appeared from carphone warehouse with the covering letter saying it's relating to a recent purchase - I've no idea what it's for. Has anyone else seen this?

    In my case they have submitted a defence and I have to fill in a questionnaire to return to the Court. If someone can link me to a post from past where someone has filled this in it would be much appreciated.

    (case is regarding auto cashback late payment.)
