I agree with what you say, but auto-cashbacks can be easily resolved. They just need a slight push.

It is true that auto-cashbacks are coughed up with a gentle nudge, albeit within a time frame of their chosing, but I think julesmay has asserted he's in a position to sue for the full amount of cashback and intends to do that, quite rightly so.

I would advise to get that LBA off ASAP. They are almost guaranteed to ignore it, if you are requesting the auto-cashback + rest of claims, but going down the MCOL route you are essentially guaranteed your full amount of cashback. Lucky geeza :p

I think you are missing the point.

Why waste effort pushing for a late payment.

They are the ones breaching the agreement - what would be their attitude towards us if we were late sending them what is required under the contract?

Doesn't matter how they react to the LBA.

Once issued they are faced with paying the amount requested in the LBA or ending up defending a court action for any amount unpaid.

Yes, if julesmay wants to go down that route then send LBA today or ASAP. In an ideal world it should have been sent a lot sooner. For me it would have been ASAP at 90 days. I know some say 2 months (60 days), but I'm nicer. :D

    .....................and of course GOOD LUCK.

Because they could state it was an admin error etc. To LBA for the full amount without asking for the auto-cashback first is not the way I would go.
I would ask for the payment within 10 days of post date or then I would go for the lot, and I would state this.
I know we are NOT allowed to make mistakes.

Doesn't matter what they state - an LBA doesn't ask why the money is late.

All it says is you breached our contract, owe me £xxx, and if you don't pay up I'll take legal action to get it all.

If they want to try out any admin errors etc they can tell the judge (who will have heard all about admin errors from other defendants who have broken contracts and not paid up when they agreed to).

But as we all know, they don't!

I think my post has been misconstrued, and I see how it may be inferred as advising to initiate MCOL without a LBA, but the first 9 words of the second para should have dispelled that uncertainty.
  • Lynsey is simply far nicer than any regular contributor to this thead :D

The general sentiments of those less inclined to abet these scoundrels seem to be: if you can grab the loot upfront, go for it.

This is of course a Money Savers forum! Getting paid altogether has lots of money saving implications.

Lynsey is lovely - but even lovely girls quite like the cut of a scoundrel! And Lynsey does seem happy to give these scoundrels a soft ride!
