quck uestion regarding sending your claims off, if sent special will it cover you for the remaining contract the claim goes missing in post, ive got my first claim to send off and if i miss it i default on the rest of the cashback, so thought i could cover myself with royalmail and claim the remainder if it walk about.
Nope. You're only covered for the amount of the remaining claims if you get consequential loss cover, which is a coupla extra quid.0 -

i am in a similar situation as to a few others on here. I took out a contract in march, and e2save have failed to pay me my auto-cashback after 2 months.
do i go straight to MCOL demanding fundamental breach, or LBA citing that is my next step unless they pay up full amount?0 -
Read the thread for all the advice you need.
LBA first (stating the fundamental breach, requesting payment of full amount,with 7 days to pay), if ignored then MCOL.0 -
what is e2save's take/line on auto cashback, from what i have read they seem to consider this a separate facet of the cashback process. the question is would a court deem non payment of auto-cashback as a fundamental breach and rendering the contract null and void0

What they "seem to consider" is not really relevant! Of course they don't just lie down and pay you.

thanks quentin- it may be an idea if we could split the thread between price match and non price match information, however i suspect the litigious route is the same regardless of type of contract0

You could give them a gentle "nudge" with an email if you want reminding them thet your auto-cashback is late. It's worked for some and might save you a LBA.

i would sooner opt for the LBA and go for the whole amount, as I am yet to claim. So in an ideal world I can win from the outset without the rollercoaster ride of whether they will pay out or not, even if you fully adhere to the T&C's, sue now rather than later0

I would be very surprised if it got to the sueing stage. The LBA should sort it, but an email might be quicker and cheaper.

No-one here has managed to get a "result" from a LBA alone. (Result being payment in full following a fundamental breach)
An email won't be accepted as a LBA - which only costs a stamp.0
