e2save problem (merged threads)

Well, I bought a phone from e2save at the end of March on a 12 month free contract.
I've read the T&Cs and I know I will have to claim cash back in 3 months time.
The problem is that I still haven't got my £111 auto cash back.
My set of T&C's say that it should take a month to get the auto cash back but the T&C's on their website say that it takes two months.
You seems to know a lot about cash back deals. Can you please tell me what I've done wrong?
All you've done wrong is to deal with e2save. When a customers doesn't follow the terms and conditions (and frequently even when they do) e2save won't pay out. When they break the T&C, you're just expected to put up with it. It happens all the time, and then they just pretend it's a one-off.0 -
Ron2256's question was really rhetorical, and aimed at sammy49!
On a practical note, though, not paying the auto cashback is a fundamental breach of the contract, and you can now pursue them via MCOL for the full amount of the cashback, not just the missing £111.
LBA them pointing this out and ask them now to pay you the outstanding £111 AND the full amount due from the original contract.
Then MCOL.0 -
The auto cashback of £111 should come soon, mine did but maybe took around 3 months and all other cheques arrived within a couple of weeks of me sending in my bills.0

.... and everything I needed to know more than once, but at least 1) when I got the contract, 2) before claiming cashback.
I`ve just written a long post, telling everyone experiencing the pleasure of claiming cashback from e2save, what exactly happened in my case, but I won`t write it down again, maybe another time.
Anyway, I signed up to this 6 months Virgin SIM offer, and they said:
SIMPLY SEND IN YOUR 3RD AND 6TH MON BILLS.
This is what I did, and now they say I was too early, how can I be too early, if obviously I can only send the 3rd month bill AFTER having been sent to me first.
Where is th thread about that what sammy_49 mentioned, can you give me the link please?
Do you think I have a chance now?
Thanks for everyone, really
Have a good day.0 -
Sammy49, I have found the thread, really useful, thanks0

my contract finishs 2 months and i cant wait to end it
everytime i sent off for my cashback, first time i recived letter saying i sent it too late and would now not be entitled to the rest of cashback, after a long time on the phone to them, they relised it was there mistake.
second time, recived letter saying it was too early so now would not be entitled to any cash back that i needed to send in the right bills at the right time, after another long time on phone to them, it was there mistake and would be sending my cheque,
third time, nothing , rang them up asking if they recived my claim, only to be told that i have either sent it to wrong place as they have no record, when i said it shows that recorded delivery shows it arrive at the address it surpose too, they said hang-on we will check again, and yes you guessed it, had it there all along and said cheque will be in the post,
everytime nothing but hassle not knowing if i was going to recive it.0 -
Right, well, auto-cashback of £171 due 17th May not received despite a whingey letter followed by LBA, so claim for full cashback of £420 + costs entered today.0

As others have said repeatedly in this thread, for sending cashback claims you're best off using Special Delivery (with Consequential Loss insurance).
I've sent some written correspondance to the 3R House address using Recorded Signed For, and it has all ended up with POD (although the ePOD is useless, e2save seem to deliberately avoid signing in the correct place which means you have to ring up RM then they forward you the entire sheet).
As I've said before, E2Save are trying the same trick with Special Delivery too.
They have a redirection in operation - so all of their mail is put in a bag, redirected, and not indivdually signed for (yes - EVEN Special Delivery).
That means the Royal Mail website will keep saying "your item has been redirected" and will never show proof of delivery. That means you can claim against Royal Mail for your full year's cashback even though - in all likelihood - E2Save have received the item!
It's a nasty little trick, which Royal Mail are aware of. As soon as I told them the postcode, they said "ah, we've launched an investigation against that address".0 -
Actually much as I now regard E2Save with disdain I might prefer them to Royal Mail!0

As already posted, it seems you need to expect the cheque not to turn up as agreed.
Not to worry - don't waste time sending more e-mails (they either ignore them or send another "please allow a further 5 days" reply).
The next MCOL stage depends how far down the route you have got:
If you are able to, of course ask for judgement, with "immediate" payment.
If they have acknowledged the summons await their defence coming from your local Court (once a defence is submitted, then the case is removed from the MCOL system and passed to your local Court).
If they have submitted their defence, and you have been sent an allocation questionnaire, then return it to the Court.
Keep on with the Claim right up to getting their cheque and having it cleared before letting it rest.
They do send the cheque eventually, but presumably would be happy if you allowed your claim to lapse by not returning court forms by their due date, and as they don't use "without prejudice" just for fun, would delight in deciding to exercise their right by deciding to withdraw their offer if they saw your court action ended before getting the money to you.
(This would mean the loss of your court fees, and having to start from scratch again.)
Quentin, I would like some more advice if possible, as I cannot find the mcol site "online tutorial."
Cheque has turned up, for only £287, which was the original offer from Emma Holloway at e2save, which I had refused. I have seen a post somewhere that says to bank this cheque, and then pursue them for the rest.
If possible I would like to proceed on mcol; my claim has been acknowledged, and there is an option to start Judgement.
Can I do that now ?
I think I have found an answer from you in post 1548 - I can bank the cheque and amend my mcol for the remaining amount, once enough time has passed that I can start the judgement process.Karma is a wonderful thing.0
