As her previous offer to you was to pay your whole claim to settle the matter, be careful before banking this cheque.
Is there a letter with the cheque stating it is in settlement of your MCOL?
If the cheque you have received has come as an out of court settlement, then if you bank it, then you are accepting it as the settlement.
What you may have read about it being safe to bank part payments are when late part payments are received after MCOL has been issued (ie not because an out of court settlement has been offered).
You can attempt to get judgement on line. If they still have time to enter a defence (by acknowledging the claim they have 28 days to get a defence in from the date the claim was served) then MCOL won't let you progress the judgement request.0 -

Just got to wait for the acknowledgement time to expire so I can proceed. Acknowledgement date was 12/06/08, got to wait 28 days from then.Karma is a wonderful thing.0 -

No - 28 days from when they were deemed to be served with your claim (as stated in your Notice of Issue). Also note that it's unlikely that you'll be able to get a judgement, since it seems CPW's modus operandi is to file a nonsense skeleton defence as a delaying tactic. That will see your claim transferred to your local court, you'll be sent an allocation questionnaire etc.0 -

Return the cheque (in their reply paid envelope), together with a letter (headed "without prejuidice") explaining you are unable to accept, and that you are expecting the promised payment of £xxx as agreed. (Also send copy of their e-mail which agreed the claim would be paid in full).
Hopefully this latest try on is just an "admin error", and they will reply with a new cheque.
Their solicitors will probably submit the "generic" defence as agsnu mentioned, and if so the court will send you a copy and details of what to do next. None of us have ended up in court, as everyone so far has got out of court settlements, but you do need to keep up to date with the court claim, and return any documents to them within the deadline to make sure you don't lose by default.0 -

If they offer u a contract before your old one has finished and you accept...theres a good chance you will LOSE your final cash back....so beware...you need to be assured that your final bill has been produced by CPW/O2 before you enter into another contract..Ive just accepted an 800minute 1000text contract sim only over 24months at £10 a month...but he started it immediately after telling me it would start after my existing E2save contract had finished, if i had not realised i would have lost my final cashback for definate(altho possibly still in lap of the Gods)....I'm still not sure ive tied this up correctly...but apparently have notes on my file indicating this...and havent signed anything....0 -

I have just purchased the Sony Ericsson K800i + Samsung B100. The phones arrived today, but I haven't opened the packs yet as there are a few points that have me confused. I have quoted from my cashback email following purchase.
I have read through previous posts looking for answers as the seniors have repeatedly advised, but I am the daftest person on the forum. Any advice would be appreciated.
It appears they are giving more room for claiming (60 days) .. but funnilyEach of the above claims must:
be received by us within 60 days of the date on the bill
be made out on our official claim form (available online at https://www.secure-mobiles.com/files/pdfs/e2_Claim_Form_Jan_08.pdf)
be accompanied by your relevant network bill, as stated above (photocopies accepted).
This bill must:
show your name, address, mobile number and tariff you are connected to.
have no carry forward balance of debt from the previous month

It's true. I did this with Just 3G Communications and they called my bluff right up until they received a CCJ notice!
It's actually a very easy thing to do (provided you've tried everything in the first instance without resorting to drastic action)

please could you define what you meant by tried everything?? because here is a funny one that i have experienced. I sent my bill along with the voucher. i sent it via royal mail first class. but somehow the voucher dissapeared from my bill. this is the second time they screwed me over like this please could anyone advice me what to do?????0 -

just follow the printed terms and conditions. You are right 6 months from connection would be 20 december. It is known that the online stuff is misleading, you need to follow the paper T+C's you have.
print off the vouchers as the links get removed,
my advice is to send in as soon as you get the relevant bill. Again follow the paper T+Cs or the [EMAIL="T+C@S"]T+C'S[/EMAIL] of offer. Print them off. good luck:j :beer: :j0 -

To answer your second question I have to say you need to read up on LBA/MCOL before going down this route as although they are not complicated, any technical error you make using either an LBA or MCOL can mean you lose - and clearly you aren't fully briefed on what a LBA is.
Well the seven days are up tomorrow and not a dickie bird not even of my cheque for my account which i had received a text message saying it was on its way, so MCol for all three claims it is tomorrow.]
However as a cheque is allegedly been raised for mine and they texted to say i would get it within 21 days (which hasn't expired)should i still be proceeding with an Mcol on this one?Mark Hughes' blue and white army0 -
Has anyone else had this particular issue with e2save?
Basically, I ordered a Virgin 6 month sim only deal on the 18 April which was dispatched by them on the 21st and the cashback deal stated that I needed to send bills in months 2, 4 and 6.
Checking the e2save website showed that this meant the first claim (month 2) had to be received by e2save by the 19 June. Now, the Royal Mail website shows my claim having been received by them on the 19 June - so all is well (even though I posted it 1st class on the 13th!) even though I left it to the last possible moment!
As such, I was perfectly happy..
However, logging into the e2save website shows the claim dates have changed in the last few days from the middle of the month (i.e. mid may-mid june) to 1st May-1st June
For instance, the website now shows:Offer Breakdown You Get
Send month 2 claim between 1st May 2008 and 1st Jun 2008 £30.00
Send month 4 claim between 1st Jul 2008 and 1st Aug 2008 £30.00
Send month 6 claim between 1st Sep 2008 and 1st Oct 2008 £30.00
I know the dates have only been changed to the above in the last few days, as I double checked them before sending my 1st claim..
EDIT: Also, one of the emails they sent me when I purchased the SIM card stated:Instalment 1 - You will need to claim 2 months from connection and you have 30 days from this date to submit your claim. Send us your claim form and monthly bill showing your name, address, mobile number and tariff you are connected to. (This bill must be no older than 28 days when we receive it and have no balance brought forward.)i.e. if you purchased on the 1st of January 2007, you need to send in the bill that is dated around the 1st March 2007, and you will have until the 30th March 2007 to do so. This is 60 days (2 months) after connection.
