    They always change dates. Had you read up on this lot first as you should have done you would know that - and an AWFUL lot more!

    Over the years I have used e2save for around 12/14 mobiles in my business. Never any problems with cashbacks until one which I chased on 9/6/2008 and when the chap was very apologetic and said it would be sent very soon. Had a text the next day confirming this and cheque came this morning. So am I lucky? I would still buy from them and only them on a cahsback deal.
    A retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.

    Having read what they do - including cynically lie in their written defences to the courts, then don't you think you have been lucky?

    You need to give more details of your problem.

    From what you say, if the 21 days are within the ts + cs, then no point in MCOL. But if they are outside of the ts + cs, then proceed.

    Just about to fill in MCOL, but have a couple of questions as to how much I can claim for.

    a. Since I've been having problems with e2save I've sent them five recorded delivery letters in addition to the claims - can I claim for that cost?

    b. I've got one cashback claim to go - the previous three have been wrongly refused, can I claim for all four or do I need to wait for the fourth one to be bounced?

    Sorry that i didn't elaborate it but deal taken out 24 march with autocashback within 2 months (the terms say raised but i know there has been debate re raised or sent to you as anything can be raised and left dormant and not sent for a number of years!)

    anyway i contacted them twice just outside the two months and got a text message on 9th saying cheque raised and will be with you within 21 days.

    Those 21 days haven't expired but as i have already waited outside their terms should i just mcol it now following the lba i sent them last Friday giving them 7 days to pay.

    What happens if I MCOL it tomorrow and the cheque arrives to me on Tuesday say? Is this a gamble on my part for the MCOL fee or if it arrives after the MCOl is filed tomorrow then tough I shouldn't be accepting anything but the whole cost?

    If a Defendant makes a payment subsequent to the issue of a MCOL, then the payment doesn't affect the outcome of the claim. (Unless the payment has been made (and accepted) as an out of court settlement.)

    eg if you claim £500, and the Defendant sends you £100 the day after the claim is issued, then you can continue with the claim. If you win judgement, then the court would order the Defendant to pay you the balance outstanding (in this example, that would be £400 plus any other costs/interest incurred since the date of the original).

    Update to the mcol for my wife's cashback.

    they agreed to make a full out of court payment, but then sent us a letter for only a partial payment (first 3 cashbacks and court costs, asking us to continue the next 2 cashback claims).

    I emailed the lovely Emma Holloway at e2save, explaining that I was not happy with their actions, and that I would continue the claim for the full amount. Emma emailed back to apologise and say it was a mistake, and that a cheque for the difference would be sent to me.

    It arrived today, by recorded delivery ! Off to bank the 2 cheques as soon as we are dressed ! Just hope they don't bounce. Got the full £455 that we claimed.

    Thanks to everyone on here who offered advice, as I doubt I would have been brave enough without it.

    In dealing with my claim, Emma Holloway at e2save has been professional and courteous, and honest. So maybe they are not all bad at E2save.

    Don't send back the receipt(s) till you are sure the cheques have cleared.

    Firstly, congrats on winning the court claim, and resolving it with e2save.

    I had been communicating with Sue at e2save and seemed very promising, as she was very courteous too by email. She also confirmed that I would receive the cheque within 7-10 days. Failed to arrive, and ever since, my emails have been ignored.

    Did cc Emma Holloway into the email trail, but no response from either of them. Maybe they are too ashamed that they cannot be trusted?

    I'd personally love to sue e2save for more than what I've claimed for! Even if the cheque arrives, I'm keen on seeing their smug faces in court! Make an example of them.... probably even take a banner into the court representing MSE! :money:
