I doubt the judge dealing with your MCOL would be senile.

If a cheque is one day late arriving they have broken the contract.

You say you played their rules, but how do you think they would play the game if you were three weeks late submitting a claim?

where in the contract did it say I would get the cheque within 2 months. This is my point.

In the ts + cs as you already said. Using the word "raised" makes no difference, and they don't defend it in court when sued.

Somewhere they claim you should allow 30 days for delivery for cheques. So, I guess, to be completely safe you should wait 2 months + 30 days.

I agree and that's how I see it for auto cashbacks. I personally wouldn't issue a LBA before the 90 days are up, but would go for the "lot" if not paid by then.

    It depends on your approach.

If you want to get the whole lot in one "hit" without the stress/time/money involved in making 4 claims, then you should go for it when they are one day late. And always remember they won't allow you 3 days to be late never mind your 30 you kindly allow them.

The question is whether or not it's actually late until 30 days.

The dates quoted on their web site for my offer do not match their email explanation sent to me.
    Send month 2 claim between 15th May 2008 and 13th Jun 2008
    Send month 4 claim between 15th Jul 2008 and 13th Aug 2008
    Send month 6 claim between 15th Sep 2008 and 14th Oct 2008

Bought 15th April so two months after connection should be 15th Jun, 15th Aug and 15th Oct they are out by a month.

Does anyone have experience of which is more reliable to follow?
Do people find they get a cheque even if I send early as their web site says?

    Thanks Bill

This was the problem my son had with his cash back claim.
I took over the claiming part for him as he was working away from home. What I did (and still do with ALL my claims) is mark the start date in a diary, then actually count the days, eg. mark 120 days, 180 days,240 days etc and write them in the diary. When the date for the first claim comes along you know you have to make the claim. If you manage to miss the date of the claim it is your own fault, and you have no one else to blame. Equally, if they don't pay up when they should, issue an L.B.A. then go to M.C.O.L.. It worked OK for me. I never lost a penny. Confidence is all it takes.
