I have had these cashback deals in the past, and always ended up claiming the money owed through MCOL.
My last ones were from Mobile Rainbow, who, after giving me the full list of excuses and reasons why they wouldn't pay me, finally paid up, in full, as soon as I started the claim with MCOL.
My son had the same problem with OneStopPhoneShop, on a price match deal. They told him he was 3 days late sending in his claim. I read their T&Cs (which he had printed off) and I sent them a Letter Before Action on his behalf.
After saying they would be defending the case, they telephoned and offered him the full amount claimed, including costs, if he would drop the case.
The claim was for the second cashback amount, and I claimed for ALL the outstanding FUTURE cashbacks, which they paid.
To all the people on here who have money owing them, do not hesitate in sending a Letter Before Action as soon as the deadline passes for the date the company is supposed to pay you.
If you have done your homework and sent in the correct bills at the correct time, don't mess about, start a claim.
It seems to me that these companies will not take the risk of going to court to try and defend their own dodgy T&Cs.
Good luck to you all.
It's thanks to people like MobileJunkie and Quentin ( who must be sick of repeating themselves about how to claim) that more and more people are having successful claims.
Thanks Guys, I for one, appreciate all that you do!0 -

You should send a Letter BA to either their registered office or their Loughborough office.
As they have fundamentally breached the contract by not sending you the automatic cashback you can now sue them for the whole amount of the cashback (plus interest on the unpaid £111). So ask for this in the lba.
So you need not be concerned over when to make your claims, or when bill 13 will come!
You are in the pound seats as they say. But get that LBA sent asap.
(With this company now it is a waste of your time and money chasing them by phone, once they default on a payment just go straight for LBA then MCOL)0 -
Hi, has anyone had problems with their ps3?i used them in the past and had bad experiences so i decided to go for the ps offer. It's 2-3 weeks past the 28 days now. I was told different things within this 2-3 weeks. First time i called, i was told it was being sent out. Others didnt give any info, just kept saying to wait. Now i'm being told it's out of stock. Customer service does not seem to know anything about these gifts. I don't know what to do since i have not had a gift offer before. Any advise? Keep waiting forever?thanks
Mine is overdue by 8 weeks. Even got the automatic 60 day cashback through yesterday. I keep ringing every week and get the same old "You have priority, out of stock, no ETA". It makes me laugh though, I have priority like everyone else who is waiting for the PS3. He did offer to change the free gift to something else. I told them PS3 or money to go and buy one. lol

I'm wondering how e2save choose which claims to pay and which to deny? They are the only cash back phone company I haven't had issues with (other than getting them to reissue a cheque that went to an old address which took 3 months to sort out). I've had 4 contracts with them over the past 4 years and have signed my parents up for one each for the past 3 years.
The last claim I sent in on 19 May, I received a cheque on 2 June and that was for a notorious price match deal from last year.
Maybe I'm just lucky, I hope so, as I'm about to sign up for another cashback deal with them. The offers aren't as good as they used to be (I need a lot of mins, going for 18months, 600mins, 500 texts) but hopefully that means they will be getting more reliable as their margins won't be so low.
Good luck to all those having problems.0 -

LBA defo the way to go
I signed up on 25th Feb, didn't get my auto cashback, issued LBA stating fundamental breech, got cheque for £111, issued MCOL, got email saying cheque was raised on 11th April but they woul give me my £25 court fee back cos they are nice.
I accepted this as after phoning up and playing stupid their systems do show cheque was added to system on 11th April. They didn't authorise it to be printed until 9th May but my concern is would a judge agree that they had "RAISED" the cheque within the 2 months? Felt it wasn't worth the agro so and now have cheque for £25 in my hand and will claim as normal for the rest.0 -

This is an issue raised on here from time to time. IMHO the date "raised" is an internal matter for them, and a red herring to you......you need not pay it any heed. It's when you are paid that's significant to you.
Think about it.....if they "raised" a cheque and, 10 years later you are still waiting for it to be issued, would you wait another 10 years for it to be issued?0 -

Quentin
how long beteen the LBA and MCOL
Would you give them 14 days for me to receive the cheque and more importantly say that you are going to MCOL if not paid within that timescale?Mark Hughes' blue and white army0 -
7 days from the date of your letter is quite sufficient.
To answer your second question I have to say you need to read up on LBA/MCOL before going down this route as although they are not complicated, any technical error you make using either an LBA or MCOL can mean you lose - and clearly you aren't fully briefed on what a LBA is.0 -

The problem is the T's&C's say "raised within 2 months." The last thing you'd want is it in front of a senile old judge that agreed with the company. Had I waited another month or two before sending the LBA I'd be more confident of arguing the case in front of a judge, but as the cheque was only 3 weeks late in arriving I felt playing by e2saves rules were the way to go.
Hopefully they will wrongly decline a cashback payment so I can sue them properly0
