A cheque will arrive and you'll be able to claim any additional court costs incurred (if any) for it not arriving on time.0

I had to fill in the Court Hearing Form by 5 June. Having waited around for the cheque - no sign of it, and emailed e2save several times, no response now.
They are useless and should be ashamed. Have sent off the Court Hearing Form, and see what happens. Anyone know what will happen now though?
"Useless" isn't the word to describe a company of their stature breaking promise after promise to get a cheque to you after causing you all this trouble.
It is not up to the Claimant to "chase" the defendant once an out of court settlement has been agreed. Once they have agreed to pay the claim in full to settle, reply confirming acceptance subject to the cheque arriving by the date promised (they say things like "allow 5 to 7 days") - insert an actual date.
If they renege on getting the promised cheque to you by the date stated, then immediately proceed with submitting the questionnaire to court.
There is a further stage anyway (the court will decide on whether or not the case is to be dealt with at a hearing, and again write with details of this which does require replying to with the fee), and delaying returning the questionnaire just prolongs the whole business.
On receipt of the questionnaire, most judges have then ordered CPW to enter a "proper" defence, rather than the shameless "We deny owing the claimant anything at all".
At some stage (prior to any hearing) they do realise you mean business and give in and the cheque will turn up complete with their demand you sign a letter drafted by them for the court saying you want the claim withdrawn.
You don't need to request this at all. Either await the cheque clearing and send them the letter amended to show they have paid the claim in full, or return it to them as requested amended to show only you have a cheque from them and are looking forward to it clearing!0 -

Don't waste time and money phoning them.
If they owe you money the proven route to follow is LBA and MCOL. Less time, cheaper and often quicker than playing their game with them.
Plus you can get some interest out of them on the late payment.0 -
Just noticed the 12mth free deals are back on the e2save website if anyones feeling brave!.
I have received all my cash backs so far and i only have this months claim to go. My contract is up on the 15th june but i dont want too close it and lose the last cashback. Anyone know when its safe to close it down?.0 -
You can safely give notice so that it cancels at the end of the minimum term without losing cashback.0

Hi, has anyone had problems with their ps3?i used them in the past and had bad experiences so i decided to go for the ps offer. It's 2-3 weeks past the 28 days now. I was told different things within this 2-3 weeks. First time i called, i was told it was being sent out. Others didnt give any info, just kept saying to wait. Now i'm being told it's out of stock. Customer service does not seem to know anything about these gifts. I don't know what to do since i have not had a gift offer before. Any advise? Keep waiting forever?thanks0

I cnsider myself to have been clued up having taken a number of contracts (30 or so) over the last 2-3 years through this company, but you have rightly got me worried. They started messing about with my last claim last year and invariably I had to chase them a couple of times before they paid up. Luckily i did this via email and fax to lower my costs.
anyway I have a couple of questions before I submit my LBA as they haven't paid the automatic cashback on my contract ( Nokia 6300- 12 months free on 12 month o2 contract taken out in March 2008). I have chased it twice via phone and nothing has been done yet (apart form the usual- 'I'll email the relevent deal to process it" that I was told.
I presume the LBA has to be done in a written format to them to their registed office and not sent via fax or email?
1. the details on my log in account on e2save have altered from what they were previously when i took out the account (25 March 2008)- although i foolishly didn't screen print that!
Now it reads
Offer Breakdown You Get
Automatic Cashback£111
Send month 6 claim between 25th Sep 2008 and 24th Oct 2008 £62.25
Send month 8 claim between 25th Nov 2008 and 24th Dec 2008 £62.25
Send month 10 claim between 25th Jan 2009 and 23rd Feb 2009 £62.25
Send month 12 claim between 25th Mar 2009 and 23rd Apr 2009 £62.25
I think this is more right than the previous one which suggested I submit my August bill for the first claim which was definately wrong.
What do others think?
2. From the schedule the last claim is made at month 12 and as with most others on o2 my billing date was the day after i was connected. As such it is the 26th.
Please forgive me if this has been discussed previously, but does this not mean we need the 13th bill for the last claim. if so this means the deal won't be a completely free one as cancelling it on 12 months won't generate the 13th bill- albeit you can cancel a few days after the bill is generated to lower your overall costs.Mark Hughes' blue and white army0
