I received this standard defence from the same firm of solicitors on the very last day before the deadline for their submission of a defence. CPW made an out of court offer for full amount (nearly £500) via e-mail from "Office of Charles Dunstone". I accepted via return of e-mail, as required, but to date I have not received either a cheque or acknowledgment of my e-mail.
I proceeded to complete the alllocation questionnaire and filed this with the court. I now have confirmation from the court that the CPW defence has been thrown out out court. The Court has given CPW a deadline to submit a proper defence, and if they do not I will be awarded judgment by the Court. I believe, after speaking to the court, that I will need to visit the court during their opening hours to obtain judgment. I presume CPW will then be issued with this and will have to pay up.

all cashback claims need to be sent to the address you got given in your T+C's at the point of sale. I would not risk sending to loughboro if that is not what you were told.

you said you have sent a copy of the correct bill to the correct address, has it delivered by royal mail? if so there is no need to jump through any more hoops. wait until the cheque is overdue then LBA then sue. they did not send me a confirmation text, i got the cheque within 28 days. why do you think they have not received your claim?
You mentioned you did not receive any vouchers in your pack, and assuming the online ones have disappeared you need to write to them requesting them, or you can sue for unfair terms and conditions that are impossible to comply with.:j :beer: :j0 -

i checked the royal mail website and it says delivered from our LOUGHBOROUGH Delivery Office on 18/04/08.
At the point of sale, i received the email from e2save saying that When sending in your claim, securely attach the appropriate chequeback
voucher to the airtime bill (chequeback vouchers can be found in your
Welcome Pack).
Please send each claim by RECORDED DELIVERY within 1 month of the date
of each of your network airtime bills with a covering letter detailing
your daytime contact numbers, to the following address:

I clicked in the download terms and conditions of offer, it asked me to send to PO BOX 462.. so i was confused which address to be send..
therefore, i sent it to PO BOX 462, since i couldn't find any cashback voucher stated PO BOX 337, Crewe, CW2 8WE. The voucher i downloaded from e2save was asked to send to PO BOX 462. And i was confused whether i need to send the original bill or the copy 1. I have read lots of threads from here and they send in original 1 and keep the copy. Do i need to resend the by original bill? And which address should i follow?

Right i haven't been on this forum in about 6-8 weeks. I eventually got payment for the 2 cash backs as they eventually gave in and i didn't have to go through with moneyclaim (just as lucky since I'm in Scotland and couldn't have used it).
Anyway, i made a mistake for my third cash back. My window to claim is 27th-6th so not the widest. I had exams that week and left it really late to send the cash back so it was due in for the 6th which was a Sunday, i posted on the 4th which was the Friday using Royal Mail Special Delivery. Now with SD there is no guarantee for delivery on the Saturday but they just say this to protect themselves just in case it doesn't and in my experience it always gets delivered (i know there is a chance it might but like i said almost always gets delivered in time).
Anyway, it didn't get delivered lol. The reason being it said on Royal Mail's online tracking that the address that it was being delivered to had a redirection and would take an extra day - that was a month ago yet its the same message still on Royal Mail's site.
Obviously i'm not gonna get the cashback from OneStop these are just the little stunts they love to pull but could i possibly get it from Royal Mail by saying it didn't reach by the guaranteed delivery date so i want the cashback from them?0 -

sounds like you have complied with the terms and conditions, what makes you think they have not received it? you have proof you have sent it and do not need to send it again,
my advice would be to wait till the cheque is overdue, then LBA then MCOL.

RM would not be liable as they said to you they could not gurantee sat delivery, also you have to take out the extra consequentiaL loss insurance which you pay extra for for that to work.

sory for asking stupid question, but i am not sure about it. Do i need to send the original paper bill? or photocopy of the bill is also acceptable by them? i sent the photocopy 1, not the original 1. The things make me worry was i read the threads from here, and many ppl failed to get their cash back. I m foreign student and this is really a large amount of money for me.

what does it say in your T+C's ? mine says send your "original monthly bill". i.e NOT A COPY
you can resend the original bill and you will need the cashback voucher... which may be a problem, i know you get 2 spares usually but not sure if that will be valid, do you have your electronic ones? other wise you may have to let this one go and make sure you can understand the T+C's better if you take out another 1... hope this answers your question:j :beer: :j0 -
hmm.. i can print out my cash back voucher since i have the pdf file. My original airtime bill is still with me.
My t&C stated :
Cash Back ClaimsCash back claims are available to customers by redemption that subscribe to a brand new 12, 18, or 24 month service agreement where all payments are up to date and paid in full. Cash backs are claimed by sending us the original claim form, correctly completed. We send this to you by email when youyour number in from a previous supplier you must also send your first bill showing the original mobile number we supplied to you.

You're probably too late. I'm afraid you should have sent the orgiginal bill unless the contract was taken out on O2 after August 2007. Read post number 5 on my guide!0

My contract was taken out on O2 after august. My contract starts on 11 dec 2007, 1st bill date was 12dec 2007. Bill after 120 days is the april bill and and i received it on 16th of april (date on bill is 12th of april). After 28 days is 10th of may. If i send the original bill now will i too late?
