No - you can sue for the full amount.
Their failure to pay the auto cashback as agreed is a fundamental breach of the contract.

I think I'll send a letter at the end of this week giving them 14 days before MCOL'ing them. I'm dreading getting home each night and opening the post to find their cheque. I'm much rather sue them for the lot now than f4rt about posting off bills every couple of months.0

So why wait till the end of the week? If they haven't sent the money as agreed, then compare what they would do to you if you didn't send a claim as agreed.
If you do receive a cheque before sending your LBA you will have an uphill job suing them for the lot.0 -
Just logged on to mycashbackclaim dot com and there is nothing for my order.
I think this means I've slipped through the system.

Got a 6 month vrigin sim only deal through e2save. Printed off cashback claims and sent off first one in accordance with t+c's. This was on 27/03/2008. Hadn't heard anything so rung today. Informed them that my cash back details have disappeared from e2save account, informed that they are having probs with software. Then asked where my 1st cashback was as i had complied with requirements. I was informed that the dates on there system were totally different. I told them that i had printed off the cashback dates from my e2save account when it was showing online. Lots of stuttering and apologies and then said to me but what were the dates of the phone bills i sent. 1st 2 as required and quoted recorded delivery number. More apologies ,then informed we received it on 29/03/2008, then told that he couldn't understand how i hadn't received payment. I then emailed the cashback details after scanning the original i had previously printed off. I for one am not holding my breath although i've followed the t+c's to be told we will look into it. I think they will do there best not to pay out and think that customers will leave it. I'm not holding my breath with this lot0

The timetable is:
1) Issue LBA
2) 10 days later issue summons
3) a month later receive defence
So this will take you to around the middle of June, when you would be required to inform the court whether or not you wish to pursue the case.0 -
Before sending an LBA, I decided to give E2Save one last chance. I telephoned 0208 896 5000 and asked to be put through to the E2Save cashback team. The operator told me she could not put me through direct, for some reason, but telephoned me back and then put me through. As I was not paying for the call, I did not mind holding on.
I have now learnt my lesson and will not waste my money on 0871 nos. If my cashback claims are not paid within 35 days of E2Save receiving my bill, I will phone once on the 0208 number. If I cannot get through, I will just send an LBA.0 -
My LBA is written - will take it to the Post Office after my post has come this morning (Just in case the cheque arrives).
