My MCOL was against The Carphone Warehouse Ltd at the address stated by oggsy. They settled (in full) out of court after their generic defence ("we don't owe nobody nuffink, honest guv") was struck out by a judge.0 -
I have issued a claim against e2save for nonpayment of cashback, and noticed this morning that they have filed a defence just in time, but I don't seem to be able to access it online - I suppose I'll have to wait until the case comes to court? I was interested to read that your claim was settled in full out of court - at what point did the judge dismiss their defence, and did e2save contact you prior to this to discuss your claim?
Sorry so many questions, but I'm just trying to guage what their.my next steps will be, or if it'll actually end up in court!

If you read through the thread you will see that they regularly enter a defence.
This doesn't mean a hearing will have to take place, but buys them more time before judgement day.
The court will send you a copy of the defence, along with instructions on what to do next.
Now that a defence has been made, the case is taken out of the MCOL system, and will be transferred to your local county court. You won't be able to access any more info on your case via the MCOL site.0 -

Of course not. A copy of the defence will be sent to you through the post. Before it comes to court, you will have to exchange all copies of any documents that you intend to rely on - both parties must be given time to see what the evidence will be well in advance of the day!0 -

I am not sure if this helps, but I lodged a MCOL claim for fundamental breach of contract (owed nearly £500 from a contract taken out last August). CPW filed standard defence a day before the deadline (after an acknowledgement of service extension). I then received a copy of the defence in the post.
CPW contacted me via e-mail from "The Office of Charles Dunstone" soon afterwards and offered to settle out of court by cheque within the next 5 working days, subject to not accepting any liability. Their e-mail to me was sent 2 weeks before the allocation deadline set by my local court and I accepted their offer via e-mail on the condition that their cheque arrived before the deadline for allocation. However, no cheque was forthcoming and I have filed the allocation papers and am awaiting my court date. I will keep you all informed.0 -
Thanks - I see their game now. The timing of the service of defence was exactly the same in my case, so I expect I'll get an e-mail this week offering to settle, but won't hold my breath for the cheque arriving!
I thought it odd that they defended it and set the wheels in motion for court action, as this will inevitably cost them as much to defend as it would to settle, as I expect that they'll send proper legal representation, rather than an office junior on a saver return to Bristol! Still, it's their money they'll be wasting, I suppose, and I won't be settling for anything less than the full amount of the contract .

Well done Microstar. It can obviously work to your advantage once a contract is breached on their behalf, though a little extra work is needed it's well worth it.
Just a thought, has anyone who has successfully sued for the whole cashback ever got another deal with the same company, or have they been "blacklisted" ????

No they just give you another contract happy in the hope you will foul up on the cashbacks. But we know better!
