Auto cashback of £11 well overdue despite two letters (latter one by special delivery & also a LBA giving them 10 working days to settle, which has just gone by on Friday 2nd). Pondering whether to file MCOL now or give them a little more time just in case they cross one another later this week. I know from another one of my claims which they've just settled, that they take an inordinate length of time to process claims and their Royal Mail redirects don't help them process efficiently. The thought of filing a claim for the full contract cashback immediately is very tempting! My question is if I file MCOL for full amount and the £11 cheque arrives, albeit after my LBA deadline date, can I legitimately return the same given they've missed the reasonable LBA deadline and proceed with the MCOL for the full contract value?0

Nicole, RM CAN NOT confirm a redirection - even if it is sent special delivery. So the sender can claim they didn't receive it, even if they did. That is WHY E2S is redirecting all of their cashback claims. RM have privately told me they are investigating that redirection, because they're worried that's why E2S is doing it. (RM are the losers, because they end up paying out on special delivery claims).0

If you have grounds for issuing a summons, and the Defendant makes just part payment of your claim, then you don't need to return the payment.
You can bank any payment and still proceed with the original claim to get all the money you are owed.
If you win the case, then the court will order the Defendant to pay the balance owing from the original claim.0 -
I posted a few months ago that at least e2save seemed to be paying out faster than previous years when people had submitted correct claims on time. I sent a 2nd claim in on my 2nd contract 26 March and paid for spec del & consq. loss. We've been up to our necks with house stuff so I hadn't appreciated that I'd not had the cheque, I've rung this morning only to be told I need to send a copy of the bill before they can process the query and this'll take 7-10 days. This company seems to be going all out to delay payment by any means - do you think staff are issued with a flow chart to see which process they have to follow to delay payment in each scenario????
Wonder if the claim I'm due to submit on my other phone will go walkabout too?
Anyone got any idea how it's possible to chivvy them along, I know I'm a pessimist but I'm worried they'll just sit on this and I'll keep going through the process of chasing on the phone and getting fobbed off - really annoying as I have followed the T&C to the letter (thanks to everyone on here).0 -
As mentioned before do not waste time "chivvying". Send Letter Before Action then Moneyclaimonline.0

On a slightly different note, I sent in my faulty phone charger with the phone in December 2007 and did not receive a replacement till January 2008. After a few weeks the second phone started playing up and tried to get it repaired at the Carphone warehouse. They could not do this because it was registered under someone else's name. When I contacted e2save they gave me all the waffle about having 2 phones and that I did not return the original phone. I pointed out that their policy was to replace a phone only when they received the old one and even showed them a sales invoice that shows the original as a minus qty, but they want the recorded delivery slip, which I cannot produce because it was 5 months ago. Is there anything I can do about this? Have written to Charles Dunstan, but am not to hopeful.0

RM appear to have lost mine, but as ive taken out consequential loss....I hope they have, as it will save the usual bi monthly worry....providing they dont renege on their promise.....
Never got confirmation that my RM Special Delivery letter was received by E2Save.....the message always came back as being redirected....but 10 days later got a cheque from E2Save for my third redemption.......
Ive still put the claim in to RM, but dropped the consequential loss bit, now just claiming for the late delivery.......0 -
The message is still showing as redirected on the website for the mobile bill I sent to E2Save a week ago by recorded delivery, do you think I should resend it by Special Delivery, or do I add the consequential loss onto this. If I do how much do you suggest I put as the value? I've £168 left to claim, including this one.

Consequential loss is how much you'd lose. If your claim was lost, you'd lose all outstanding claims. So you'd lose £168.0 -

Nothing in today's post (6.5.08) and LBA deadline expired on 3.5.08 after giving them 17 days to settle. Filed MCOL this evening for the full contract cashback value of £210 + £25 fees - will post outcome on this thread in due course.0
